1 2 #1. Page 3, line 2, by inserting after the word
1 3 "hiring" the following: ", consistent with the
1 4 requirements of this section".
1 5 #2. By striking page 7, line 20, through page 8,
1 6 line 6, and inserting the following:
1 7 "9. REHABILITATION AND DISCIPLINE. The employer
1 8 shall provide substance abuse evaluation, and
1 9 treatment if recommended by the evaluation, with costs
1 10 apportioned as provided under the employee benefit
1 11 plan or at employer expense, if there is no employee
1 12 benefit plan, the first time an employee's drug or
1 13 alcohol test indicates the presence of drugs or
1 14 alcohol in violation of the employer's written policy.
1 15 An employer shall not take disciplinary action against
1 16 an employee due to the employee's drug or alcohol
1 17 involvement the first time the employee's drug or
1 18 alcohol test indicates the presence of drugs or
1 19 alcohol if the employee undergoes a substance abuse
1 20 evaluation, and if the employee successfully completes
1 21 substance abuse treatment if treatment is recommended
1 22 by the evaluation. However, if an employee fails to
1 23 undergo a substance abuse evaluation when the
1 24 employee's drug or alcohol test indicates the presence
1 25 of drugs or alcohol, or if an employee fails to
1 26 successfully complete substance abuse treatment when
1 27 recommended by an evaluation, the employee may be
1 28 disciplined up to and including discharge. The
1 29 substance abuse evaluation and treatment provided by
1 30 the employer shall take place under a program approved
1 31 by the Iowa department of public health or accredited
1 32 by the joint commission on the accreditation of health
1 33 care organizations. This subsection shall not apply
1 34 to a drug or alcohol test of a prospective employee."
