1 2 #1. Page 2, line 6, by striking the words
1 3 "Reasonable suspicion" and inserting the following:
1 4 "Probable cause".
1 5 #2. Page 2, by striking lines 8 through 11 and
1 6 inserting the following: "is conducted when the
1 7 employer has probable cause to believe that an
1 8 employee's faculties are impaired on the job. For
1 9 purposes of this paragraph, an employer has probable
1 10 cause to believe that an employee's faculties are
1 11 impaired on the job if the employer is investigating
1 12 an accident in the workplace and all of the following
1 13 conditions are met:
1 14 (1) The employer has reasonable grounds to believe
1 15 that the employee proposed to be tested either
1 16 directly caused or directly contributed to the
1 17 accident.
1 18 (2) The employer has reasonable grounds to believe
1 19 that the employee's faculties were impaired and that
1 20 the impairment was likely a substantial factor in
1 21 causing the accident.
1 22 (3) The accident results in a personal injury
1 23 which requires medical treatment away from the
1 24 workplace or damage to property, including equipment,
1 25 in an amount reasonably estimated to exceed three
1 26 thousand dollars at the time of the accident.
1 27 (4) Prior to the accident, the employer has
1 28 provided the employee to be tested with written notice
1 29 of the employer's rules or policies regarding alcohol
1 30 and drugs and testing when a workplace accident or
1 31 injury occurs."
1 32 #3. Page 5, by striking lines 15 through 23 and
1 33 inserting the following:
1 34 "d. Employers may conduct probable cause drug or
1 35 alcohol testing."
1 36 #4. Page 6, line 26, by inserting after the word
1 37 "policy" the following: "and subject to the
1 38 requirements of subsection 7".
