PAG LIN 1 1 Section 1. NEW SECTION. 7E.9 INNOVATION ZONES. 1 2 1. The purpose of this section is to enable local 1 3 jurisdictions to establish community partnerships to redirect 1 4 existing public funds to achieve improved results for children 1 5 and families. The state and local jurisdictions shall 1 6 negotiate new relationships in the decategorization of funding 1 7 to local jurisdictions which share the risk related to and 1 8 responsibility for achieving improved results. 1 9 2. An innovation zone board is created within the council 1 10 on human investment. The staff of the council on human 1 11 investment shall act as staff to the board. The board shall 1 12 select a chairperson, annually, from its membership. A simple 1 13 majority of the members of the board shall constitute a 1 14 quorum. On or before June 30, 1997, the board shall do all of 1 15 the following: 1 16 a. Issue a request for applications to be submitted by 1 17 local jurisdictions to participate in innovation zones in 1 18 order to develop new, community-based strategies which are 1 19 cross-system in focus, to improve results for children and 1 20 families. 1 21 b. Select from the requests received, at least three 1 22 jurisdictions to develop and implement innovation zone plans. 1 23 The board shall establish criteria for selection of the 1 24 jurisdictions. Selection criteria shall include a component 1 25 which measures the comprehensiveness of the plan and the 1 26 capacity of the jurisdiction to implement the plan. 1 27 c. Provide technical assistance, if requested, to assist 1 28 selected jurisdictions in developing and implementing the 1 29 innovation zone plans, including but not limited to assistance 1 30 in providing information regarding state and federal funding 1 31 directed to the local jurisdiction for use in implementation 1 32 of the plans. 1 33 d. Negotiate with local jurisdictions the state and local 1 34 jurisdiction duties in implementing the innovation zone plans. 1 35 The negotiations shall include methods to evaluate the 2 1 performance of the innovation zones. The board shall 2 2 coordinate and respond to any requests from a local 2 3 jurisdiction relating to waiver of existing rules or 2 4 regulations, the pooling and redirecting of existing state 2 5 funds, and the seeking of federal waivers. 2 6 e. Provide for maximum flexibility and creativity in the 2 7 designing and implementation of innovation zone plans with an 2 8 emphasis on the plans' potential for improving results for 2 9 children and families. 2 10 f. Review and approve or disapprove any provision in an 2 11 innovation zone plan submitted which requires the waiver or 2 12 superseding of any state rule relating to local jurisdiction 2 13 actions or expenditure of funds for services provided to 2 14 children and families. 2 15 g. Assist a local jurisdiction and support a local 2 16 jurisdiction's efforts in obtaining exemptions to any state 2 17 law. The board shall report provisions included in a local 2 18 jurisdiction innovation zone plan which require the waiver or 2 19 superseding of a state law or rule to the general assembly for 2 20 review and necessary action. 2 21 3. A local jurisdiction seeking to develop and implement 2 22 an innovation zone plan shall do all of the following: 2 23 a. Define the geographic service area of the local 2 24 jurisdiction. 2 25 b. Establish a local jurisdiction innovation zone 2 26 governing body which shall develop and implement the 2 27 innovation zone plan. In its initial application, the local 2 28 jurisdiction shall demonstrate the involvement in the 2 29 governing body, which controls the allocation of funds 2 30 anticipated to be used in funding the innovation zone plan, of 2 31 community leaders, employees of departments, agencies and 2 32 offices of the local jurisdiction which provide services to 2 33 children and families, and consumers. 2 34 c. Develop a budget for the development and implementation 2 35 of the innovation zone plan which includes a commitment of 3 1 ongoing local funding and which also involves the commitment 3 2 of other private and public resources to the innovation zone. 3 3 d. Negotiate the specific requirements of the innovation 3 4 zone plan and implementation of the plan including the 3 5 specific duties of the state and local jurisdictions. The 3 6 plans may include provisions for local jurisdiction actions or 3 7 expenditure of funds under the plan which involve waiver of 3 8 state rules relating to services to children and families. 3 9 4. The innovation zone board shall include all of the 3 10 following members: 3 11 a. The directors, or their designees, of the department of 3 12 human services, the department of human rights, the department 3 13 of education, the Iowa department of public health, the 3 14 department of employment services, the department of 3 15 management, and any other state departments or agencies, as 3 16 necessary, as determined by the board. 3 17 b. Four members of the general assembly shall serve as ex 3 18 officio, nonvoting members. The legislative members shall be 3 19 appointed by the majority leader of the senate, after 3 20 consultation with the president of the senate, by the minority 3 21 leader of the senate, and by the speaker of the house, after 3 22 consultation with the majority leader and minority leader of 3 23 the house of representatives. Appointments shall comply with 3 24 sections 69.16 and 69.16A. Vacancies shall be filled by the 3 25 original appointing authority and in the manner of the 3 26 original appointments. Legislative members shall serve terms 3 27 of two years and shall receive compensation pursuant to 3 28 section 2.12. 3 29 c. Additional members, which the governor shall appoint, 3 30 who are not affiliated with a state agency but who are members 3 31 of the general public with expertise or interest in children 3 32 and family issues. 3 33 5. For the purposes of this section, "local jurisdiction" 3 34 means one or more cities, counties, or school districts or a 3 35 combination of any of these entities. 4 1 Sec. 2. APPROPRIATION – INNOVATION ZONE ADMINISTRATION. 4 2 There is appropriated from the general fund of the state to 4 3 the department of management for the fiscal year beginning 4 4 July 1, 1996, and ending June 30, 1997, the following amount, 4 5 or so much thereof as is necessary, for the following purpose: 4 6 For the administration of the innovation zone program, and 4 7 for salaries, support, maintenance, miscellaneous purposes, 4 8 and for not more than the following full-time equivalent 4 9 positions: 4 10 .................................................. $ 60,000 4 11 ................................................FTEs 1.00 4 12 EXPLANATION 4 13 This bill provides for the establishment of local 4 14 innovation zones to provide services to children and families. 4 15 The bill creates an innovation zone board within the council 4 16 on human investment consisting of the directors or the 4 17 directors' designees of the department of human services, the 4 18 department of human rights, the department of education, the 4 19 Iowa department of public health, the department of employment 4 20 services, the department of management, and other state 4 21 agencies. Additional members are to include individuals 4 22 appointed by the governor who are not affiliated with a state 4 23 agency but who are members of the general public with 4 24 expertise or interest in children and family issues. Four 4 25 members of the general assembly are also to be appointed by 4 26 the board as ex officio, nonvoting members. The bill provides 4 27 that the board is to utilize the staff of the council on human 4 28 investment as staff to the board. 4 29 The bill directs the board, on or before June 30, 1997, to 4 30 issue requests for applications and negotiate agreements with 4 31 innovation zone entities to provide services to children and 4 32 families; to select at least three jurisdictions from the 4 33 applications submitted for development and implementation of 4 34 innovation zone plans; to provide technical assistance to the 4 35 innovation zones, if requested; to negotiate state and local 5 1 jurisdiction duties for implementing innovation zone plans; to 5 2 provide for maximum flexibility and encourage creativity in 5 3 design and implementation of innovation zone plans; and to 5 4 assist and support local jurisdictions in obtaining exemptions 5 5 from state law or rules to implement innovation zone plans. 5 6 The bill also establishes certain duties of an innovation 5 7 zone entity which submits an application including that the 5 8 entity shall define the geographic service area of the 5 9 innovation zone, develop an innovation zone plan, establish a 5 10 local governing body to be responsible for the development and 5 11 implementation of the plan, develop a budget, and negotiate 5 12 the specifics of the plan. 5 13 The bill also provides for the appropriation of not more 5 14 than $60,000 from the state general fund to the department of 5 15 management for administration of the innovation zone program 5 16 including authorization of one full-time equivalent position. 5 17 LSB 4432SC 76 5 18 pf/sc/14.1
