  1  1    Section 1.  There is appropriated from the general fund of
  1  2 the state to the Iowa communications network fund created in
  1  3 section 8D.14 for the fiscal year beginning July 1, 1996, and
  1  4 ending June 30, 1997, the following amount, or so much thereof
  1  5 as is necessary, to be used for salaries, support,
  1  6 maintenance, miscellaneous purposes, for the subsidization of
  1  7 video rates for authorized users as determined by the Iowa
  1  8 telecommunications and technology commission and consistent
  1  9 with chapter 8D, and for not more than the following full-time
  1 10 equivalent positions:

  1 13    Sec. 2.  There is appropriated from the general fund of the
  1 14 state to the Iowa communications network fund created in
  1 15 section 8D.14 for the fiscal year beginning July 1, 1996, and
  1 16 ending June 30, 1997, the following amount, or so much thereof
  1 17 as is necessary, to be used for the purpose designated:
  1 18    For debt service:  
  1 19 .................................................. $ 12,754,000
  1 20    Upon the appropriation of the funds in this section to the
  1 21 Iowa communications network fund, the Iowa telecommunications
  1 22 and technology commission shall immediately transfer
  1 23 $12,754,000 of the appropriated amount to a separate fund
  1 24 established in the office of the treasurer of state, to be
  1 25 used solely for debt service for the Iowa communications
  1 26 network.  The commission shall certify to the treasurer of
  1 27 state when a debt service payment is due, and upon receipt of
  1 28 the certification the treasurer shall make the payment.  The
  1 29 commission shall pay any additional amount due from funds
  1 30 deposited in the Iowa communications network fund.
  1 31    Sec. 3.  Section 8D.11, subsection 1, Code 1995, is amended
  1 32 to read as follows:
  1 33    1.  The commission may purchase, lease-purchase, lease, and
  1 34 improve property, and equipment, and services for
  1 35 telecommunications for public and private agencies and may
  2  1 dispose of property and equipment when not necessary for its
  2  2 purposes.  However, the commission shall not enter into a
  2  3 contract for the purchase, lease-purchase, lease, or
  2  4 improvement of property, or equipment, or services for
  2  5 telecommunications pursuant to this subsection in an amount
  2  6 greater than five hundred thousand one million dollars without
  2  7 prior authorization by a constitutional majority of each house
  2  8 of the general assembly, or approval by the legislative
  2  9 council if the general assembly is not in session.  The lease-
  2 10 purchase agreement may contain provisions, including interest,
  2 11 term, and obligations to make payments on the lease-purchase
  2 12 agreements, beyond the budget year in which the lease-purchase
  2 13 agreement is entered.  For the purpose of funding its
  2 14 obligation to furnish moneys under a lease-purchase agreement
  2 15 entered into pursuant to this section, the treasurer of state,
  2 16 with the assistance of the Iowa telecommunications and
  2 17 technology commission or the treasurer of state's duly
  2 18 authorized agent or representative, may enter into a master
  2 19 lease agreement to borrow moneys to be used to purchase
  2 20 property or equipment for telecommunications services for
  2 21 public or private agencies.  The obligations may be in such
  2 22 form, for such term, bearing such interest, and containing
  2 23 such provisions as the Iowa telecommunications and technology
  2 24 commission, in consultation with the treasurer of state, deems
  2 25 necessary or appropriate.  The commission shall not issue any
  2 26 bonding or other long-term financing arrangements as defined
  2 27 in section 12.30, subsection 1, paragraph "b".
  2 28    PARAGRAPH DIVIDED.  The commission also shall not provide
  2 29 or resell communications services to entities other than
  2 30 public and private agencies.  The public or private agency
  2 31 shall not provide communication services of the network to
  2 32 another entity unless otherwise authorized pursuant to this
  2 33 chapter.  The commission may arrange for joint use of
  2 34 available services and facilities, and may enter into leases
  2 35 and agreements with private and public agencies with respect
  3  1 to the Iowa communications network, and public agencies are
  3  2 authorized to enter into leases and agreements with respect to
  3  3 the network for their use and operation.  Rentals and other
  3  4 amounts due under the agreements or leases entered into
  3  5 pursuant to this section by a state agency are payable from
  3  6 funds annually appropriated by the general assembly or from
  3  7 other funds legally available.  Other public agencies may pay
  3  8 the rental costs and other amounts due under an agreement or
  3  9 lease from their annual budgeted funds or other funds legally
  3 10 available or to become available.  This section comprises a
  3 11 complete and independent authorization and procedure for a
  3 12 public agency, with the approval of the commission, to enter
  3 13 into a lease or agreement and related security enhancement
  3 14 arrangements and this section is not a qualification of any
  3 15 other powers which a public agency may possess and the
  3 16 authorizations and powers granted under this section are not
  3 17 subject to the terms, requirements, or limitations of any
  3 18 other provisions of law.  All moneys received by the
  3 19 commission from agreements and leases entered into pursuant to
  3 20 this section with private and public agencies shall be
  3 21 deposited in the Iowa communications network fund.
  3 22    Sec. 4.  Section 68B.35, subsection 2, paragraph e, Code
  3 23 1995, is amended to read as follows:
  3 24    e.  Members of the banking board, the ethics and campaign
  3 25 disclosure board, the credit union review board, the economic
  3 26 development board, the employment appeal board, the
  3 27 environmental protection commission, the health facilities
  3 28 council, the Iowa business investment corporation board of
  3 29 directors, the Iowa finance authority, the Iowa seed capital
  3 30 corporation, the Iowa public employees' retirement system
  3 31 investment board, the lottery board, the natural resource
  3 32 commission, the board of parole, the petroleum underground
  3 33 storage tank fund board, the public employment relations
  3 34 board, the state racing and gaming commission, the state board
  3 35 of regents, the tax review board, the transportation
  4  1 commission, the office of consumer advocate, the utilities
  4  2 board, the Iowa telecommunications and technology commission,
  4  3 and any full-time members of other boards and commissions as
  4  4 defined under section 7E.4 who receive an annual salary for
  4  5 their service on the board or commission.  
  4  6                           EXPLANATION
  4  7    This bill relates to the Iowa communications network by
  4  8 appropriating moneys for various network purposes, amending
  4  9 the commission's existing lease-purchase authority, and
  4 10 providing for the disclosure of certain financial information
  4 11 of Iowa telecommunications and technology commission members.
  4 12    The bill appropriates for the 1996-1997 fiscal year
  4 13 $2,400,000 from the general fund for the subsidization of
  4 14 video rates for certain authorized users and for the support
  4 15 of 57 FTEs, and $12,754,000 from the general fund for debt
  4 16 service.
  4 17    The bill increases the maximum telecommunications contract
  4 18 amount, which can be entered into without general assembly or
  4 19 legislative council approval, from $500,000 to $1 million.
  4 20 The bill also provides additional authority for the commission
  4 21 to enter into lease-purchase agreements.
  4 22    The bill amends section 68B.35 by including the members of
  4 23 the Iowa telecommunications and technology commission as
  4 24 persons subject to the personal financial disclosure
  4 25 requirements applicable to certain officials, members of the
  4 26 general assembly, and candidates.
