  4 26 from funds appropriated in subsection 10 shall revert to the
  4 27 fund from which appropriated on August 30, 1999.
  4 28    Sec. 4.  LEGISLATIVE OVERSIGHT.
  4 29    1.  The department shall work with the legislative fiscal
  4 30 bureau to develop a process to provide quarterly reports of
  4 31 highway construction and maintenance programs and highway
  4 32 expenditures to the joint appropriations subcommittee on
  4 33 transportation, infrastructure, and capitals.
  4 34    2.  The department shall provide the members of the joint
  4 35 appropriations subcommittee on transportation, infrastructure,
  5  1 and capitals with a report regarding the implementation of
  5  2 recommendations from the governor's blue ribbon road use tax
  5  3 fund task force by November 1, 1996.  
  5  4                           DIVISION II
  5  5                        CAPITAL PROJECTS
  5  6                        BOARD OF REGENTS
  5  7    Sec. 5.  There is appropriated from the rebuild Iowa
  5  8 infrastructure fund of the state to the state board of regents
  5  9 for the fiscal period beginning July 1, 1996, and ending June
  5 10 30, 1997, the following amounts, or so much thereof as is
  5 11 necessary, to be used as follows:
  5 12    1.  For construction and renovation of the biological
  5 13 sciences complex at the state university of Iowa:  
  5 14 .................................................. $ 14,900,000
  5 15    2.  For construction and renovation of the engineering
  5 16 building at the state university of Iowa:  
  5 17 .................................................. $  5,900,000
  5 18    3.  For construction of the national advanced driving
  5 19 simulator building at the state university of Iowa:  
  5 20 .................................................. $  2,300,000
  5 21 Funds provided for the construction of the facility to house
  5 22 the national advanced driving simulator in fiscal years
  5 23 beginning July 1, 1996, and July 1, 1997, shall only be
  5 24 expended upon receiving notification from the national highway
  5 25 traffic safety administration that the United States congress
  5 26 has authorized the construction of the national advanced
  5 27 driving simulator, that federal funds have been appropriated
  5 28 to begin construction, and that delivery of the motion base,
  5 29 graphics system, and integrating software will take place in
  5 30 substantial compliance with the United States department of
  5 31 transportation's acquisition schedule as set forth in the
  5 32 cooperative agreement between the state university of Iowa and
  5 33 the national highway traffic safety administration.
  5 34    4.  For construction and renovation of the intensive
  5 35 livestock research facilities at Iowa state university of
  6  1 science and technology:

  6  3    5.  For Phase I construction of the engineering teaching
  6  4 and research complex at Iowa state university of science and
  6  5 technology:

  6 15                    DEPARTMENT OF CORRECTIONS
  6 16    Sec. 6.  There is appropriated from the rebuild Iowa
  6 17 infrastructure fund of the state to the department of
  6 18 corrections for the fiscal year beginning July 1, 1996, and
  6 19 ending June 30, 1997, the following amount, or so much thereof
  6 20 as is necessary, to be used for the purpose designated:
  6 21    For connection of the Clarinda correctional facility with
  6 22 the Iowa communications network:  
  6 23 .................................................. $    150,000
  6 24                 DEPARTMENT OF GENERAL SERVICES
  6 25    Sec. 7.  There is appropriated from the rebuild Iowa
  6 26 infrastructure fund of the state to the department of general
  6 27 services for the fiscal year beginning July 1, 1996, and
  6 28 ending June 30, 1997, the following amounts, or so much
  6 29 thereof as is necessary, to be used for the purposes
  6 30 designated:
  6 31    1.  For exterior state capitol building restoration:  
  6 32 .................................................. $  9,300,000
  6 33    2.  For major maintenance needs including health, life and
  6 34 fire safety and for compliance with the federal Americans with
  6 35 Disabilities Act for state-owned buildings and facilities:

  7  4    As a condition of receiving this appropriation, private
  7  5 matching funds must be contributed on a dollar-for-dollar

  7  9    Notwithstanding section 8.33, unencumbered or unobligated
  7 10 funds remaining on June 30, 2001, from the funds appropriated
  7 11 in this section, shall revert to the rebuild Iowa
  7 12 infrastructure fund of the state on August 31, 2001.  
  7 13                 DEPARTMENT OF NATURAL RESOURCES
  7 14    Sec. 8.  There is appropriated from the marine fuel tax
  7 15 receipts deposited in the general fund of the state to the
  7 16 department of natural resources for the fiscal year beginning
  7 17 July 1, 1996, and ending June 30, 1997, the following amount,
  7 18 or so much thereof as is necessary, to be used for the purpose
  7 19 designated:
  7 20    For the purpose of funding capital projects traditionally
  7 21 funded from marine fuel tax receipts for the purposes
  7 22 specified in section 452A.79:  
  7 23 .................................................. $  1,800,000
  7 24    Notwithstanding section 8.33, unencumbered or unobligated
  7 25 funds remaining on June 30, 1998, from the funds appropriated
  7 26 in this section, shall revert to the general fund of the state
  7 27 on August 31, 1998.  
  7 28                  DEPARTMENT OF PUBLIC DEFENSE
  7 29    Sec. 9.  There is appropriated from the rebuild Iowa
  7 30 infrastructure fund of the state to the department of public
  7 31 defense for the fiscal year beginning July 1, 1996, and ending
  7 32 June 30, 1997, the following amount, or so much thereof as is
  7 33 necessary, to be used for the purpose designated:
  7 34    For maintenance and repair of national guard armories and
  7 35 facilities:  
  8  1 .................................................. $    567,000
  8  2    Notwithstanding section 8.33, unencumbered or unobligated
  8  3 funds remaining on June 30, 1997, from the funds appropriated
  8  4 in this section, shall revert to the rebuild Iowa
  8  5 infrastructure fund of the state on August 31, 1997.  
  8  6                   DEPARTMENT OF PUBLIC SAFETY
  8  7    Sec. 10.  There is appropriated from the rebuild Iowa
  8  8 infrastructure fund of the state to the department of public
  8  9 safety for the fiscal year beginning July 1, 1996, and ending
  8 10 June 30, 1997, the following amount, or so much thereof as is
  8 11 necessary, to be used for the purpose designated:
  8 12    To purchase terminal equipment and pay other costs
  8 13 associated with upgrade of the existing Iowa online warrants
  8 14 and articles (IOWA) system to provide faster data transmission
  8 15 capabilities to existing subscribers, and in cooperation with
  8 16 the department of public defense to establish comparable data
  8 17 transmission service to the emergency management office in
  8 18 each county of the state.  
  8 19 .................................................. $    300,000
  8 20               STATE DEPARTMENT OF TRANSPORTATION
  8 21    Sec. 11.  There is appropriated from the rebuild Iowa
  8 22 infrastructure fund of the state to the state department of
  8 23 transportation for the fiscal year beginning July 1, 1996, and
  8 24 ending July 30, 1997, the following amount, or so much thereof
  8 25 as is necessary, to be used for the purpose designated:
  8 26    For acquiring, constructing, and improving recreational
  8 27 trails within the state:  
  8 28 .................................................. $  1,000,000
  8 29    Notwithstanding section 8.33, unencumbered or unobligated
  8 30 funds remaining on June 30, 1997, from the funds appropriated
  8 31 in this section, shall revert to the rebuild Iowa
  8 32 infrastructure fund of the state on August 31, 1997.  
  8 33                 COMMISSION OF VETERANS AFFAIRS
  8 34    Sec. 12.  There is appropriated from the rebuild Iowa
  8 35 infrastructure fund of the state to the commission of veterans
  9  1 affairs for the fiscal year beginning July 1, 1996, and ending
  9  2 June 30, 1997, the following amounts, or so much thereof as is
  9  3 necessary, to be used for the purposes designated:
  9  4    1.  For records automation:  
  9  5 .................................................. $     60,000
  9  6    2.  For food preparation and dining room expansion:  
  9  7 .................................................. $    500,000
  9  8    Notwithstanding section 8.33, unencumbered or unobligated
  9  9 funds remaining on June 30, 1997, from the funds appropriated
  9 10 in this section, shall revert to the rebuild Iowa
  9 11 infrastructure fund of the state on August 31, 1997.  
  9 12                IOWA COMMUNICATIONS NETWORK FUND
  9 13    Sec. 13.  There is appropriated from the rebuild Iowa
  9 14 infrastructure fund of the state to the Iowa communications
  9 15 network fund created in section 8D.14 for the fiscal year
  9 16 beginning July 1, 1996, and ending June 30, 1997, the
  9 17 following amount, or so much thereof as is necessary:  
  9 18 .................................................. $ 21,184,728
  9 19                   IOWA STATE FAIR FOUNDATION
  9 20    Sec. 14.  There is appropriated from the rebuild Iowa
  9 21 infrastructure fund of the state to the Iowa state fair
  9 22 foundation for the fiscal year beginning July 1, 1996, and
  9 23 ending June 30, 1997, the following amounts, or so much
  9 24 thereof as is necessary, to be used for the purposes
  9 25 designated:
  9 26    1.  For improvements to the grandstand:  
  9 27 .................................................. $    750,000
  9 28    2.  For improvements to the cattle building:  
  9 29 .................................................. $    500,000
  9 30    3.  For improvements to the swine building:  
  9 31 .................................................. $    500,000
  9 32    Notwithstanding section 8.33, unencumbered or unobligated
  9 33 funds remaining on June 30, 1998, from the funds appropriated
  9 34 in this section, shall revert to the rebuild Iowa
  9 35 infrastructure fund of the state on August 31, 1998.  
 10  1                          DIVISION III
 10  2                        STATUTORY CHANGES
 10  3    Sec. 15.  Section 8D.13, Code Supplement 1995, is amended
 10  4 by adding the following new subsection:
 10  5    NEW SUBSECTION.  19.  Access to the network shall be
 10  6 offered to the department of public safety and the department
 10  7 of public defense for the purpose of establishing and
 10  8 operating a shared data network providing law enforcement,
 10  9 emergency management, disaster service, emergency warning, and
 10 10 other emergency information dissemination services to federal,
 10 11 state, and local law enforcement agencies as provided in
 10 12 section 80.9, and local emergency management offices
 10 13 established under the authority of sections 29C.9 and 29C.10.
 10 14    Sec. 16.  Section 306C.18, subsection 4, Code 1995, is
 10 15 amended to read as follows:
 10 16    4.  The fee for both types of permits shall be fifty one
 10 17 hundred dollars for the initial fee and ten fifteen dollars
 10 18 for each annual renewal.  The fees collected for the above
 10 19 permits shall be credited to a special account entitled the
 10 20 "highway beautification fund" and all salaries and expenses
 10 21 incurred in administering this chapter shall be paid from this
 10 22 fund or from specific appropriations for this purpose, except
 10 23 that surveillance of, and removal of, advertising devices
 10 24 performed by regular maintenance personnel are not to be
 10 25 charged against the account.
 10 26    Sec. 17.  Section 312.2, subsection 18, Code 1995, is
 10 27 amended by striking the subsection.
 10 28    Sec. 18.  1994 Iowa Acts, chapter 1199, section 10, as
 10 29 amended by 1995 Iowa Acts, chapter 220, section 31, is amended
 10 30 by adding the following new unnumbered paragraph:
 10 31    NEW UNNUMBERED PARAGRAPH.  The provisions of section 8.33
 10 32 do not apply to the funds appropriated in this section, and
 10 33 unobligated or unencumbered funds on June 30, 1996, shall
 10 34 remain available for expenditure for the purposes designated
 10 35 until June 30, 1999.  Unencumbered or unobligated funds
 11  1 remaining on June 30, 1999, from funds appropriated in this
 11  2 section shall revert to the fund from which appropriated on
 11  3 August 30, 1999.  
 11  4                           DIVISION IV
 11  5                  SCHOOL IMPROVEMENT TECHNOLOGY
 11  6    Sec. 19.  NEW SECTION.  295.1  LEGISLATIVE FINDINGS AND
 11  7 INTENT.
 11  8    The general assembly finds that it is in the public
 11  9 interest to develop and equitably fund instructional
 11 10 technology within the public schools of this state to ensure
 11 11 that school students, teachers, and administrators are
 11 12 equipped and prepared to excel in the twenty-first century.
 11 13 Toward that goal, it is the intent of this chapter to
 11 14 establish and fund a school improvement technology program.
 11 15 It is the intent of the general assembly that funds received
 11 16 under a school improvement technology program be used to
 11 17 supplement, not supplant, funds schools are expending for
 11 18 technology.
 11 19    Sec. 20.  NEW SECTION.  295.2  SCHOOL IMPROVEMENT
 11 20 TECHNOLOGY APPROPRIATION.
 11 21    1.  a.  There is appropriated from the general fund of the
 11 22 state to the department of education for the fiscal year
 11 23 beginning July 1, 1996, and ending June 30, 1997, the sum of
 11 24 fifteen million dollars for the school improvement technology
 11 25 program.
 11 26    b.  There is appropriated from the rebuild Iowa
 11 27 infrastructure account of the state to the department of
 11 28 education for the fiscal year beginning July 1, 1996, and
 11 29 ending June 30, 1997, the sum of fifteen million dollars for
 11 30 the school improvement technology program.
 11 31    c.  There is appropriated from the general fund of the
 11 32 state to the department of education for each fiscal year of
 11 33 the fiscal period beginning July 1, 1997, and ending June 30,
 11 34 2001, the sum of thirty million dollars for the school
 11 35 improvement technology program.
 12  1    2.  From the moneys appropriated in subsection 1, the
 12  2 amount of moneys allocated to school districts shall be in the
 12  3 proportion that the basic enrollment of a district bears to
 12  4 the sum of the basic enrollment of all districts in the state
 12  5 for the budget year.  However, for the fiscal period beginning
 12  6 July 1, 1996, and ending June 30, 1998, a school district
 12  7 shall not receive less than fifteen thousand dollars in each
 12  8 fiscal year, and the Iowa braille and sight saving school and
 12  9 the state school for the deaf shall each not receive less than
 12 10 sixty thousand dollars in each fiscal year.
 12 11    For the fiscal year beginning July 1, 1998, and each
 12 12 succeeding year in which moneys are appropriated in subsection
 12 13 1, the Iowa braille and sight saving school and the state
 12 14 school for the deaf shall not receive less than fifteen
 12 15 thousand dollars in each fiscal year.  The Iowa braille and
 12 16 sight saving school, the state school for the deaf, and the
 12 17 Price laboratory school at the university of northern Iowa
 12 18 shall annually certify their basic enrollments to the
 12 19 department of education by October 1.
 12 20    3.  For each year in which moneys are appropriated under
 12 21 subsection 1, the department of education shall notify the
 12 22 department of revenue and finance of the amount to be paid to
 12 23 each school district based upon the distribution plan set
 12 24 forth for the appropriation made pursuant to this section.
 12 25 The allocation to each school district under this section
 12 26 shall be made in one payment on or about October 15 of the
 12 27 fiscal year in which the appropriation is made, taking into
 12 28 consideration the relative budget and cash position of the
 12 29 state resources.  Prior to the receipt of funds, school
 12 30 districts shall provide to the department of education
 12 31 adequate assurance that they have developed or are developing
 12 32 a technology plan as required by section 295.3 and that funds
 12 33 received under this section will be used in accordance with
 12 34 the required technology plan.  However, approval of the plan
 12 35 by the department is not required.
 13  1    4.  Moneys received under this section shall not be
 13  2 commingled with state aid payments made under section 257.16
 13  3 to a school district and shall be accounted for by the local
 13  4 school district separately from state aid payments.
 13  5    5.  Payments made to school districts under this section
 13  6 are miscellaneous income for purposes of chapter 257.  Each
 13  7 local school district shall maintain a separate technology
 13  8 fund account within its budget for payments received and
 13  9 expenditures made pursuant to this section.
 13 10    6.  Moneys received under this section shall not be used
 13 11 for payment of any collective bargaining agreement or
 13 12 arbitrator's decision negotiated or awarded under chapter 20.
 13 13    7.  For purposes of this section, "school district" means a
 13 14 school district, the Iowa braille and sight saving school, the
 13 15 state school for the deaf, and the Price laboratory school at
 13 16 the university of northern Iowa.
 13 17    Sec. 21.  NEW SECTION.  295.3  SCHOOL IMPROVEMENT
 13 18 TECHNOLOGY PLANNING.
 13 19    1.  The board of directors of a school district shall adopt
 13 20 a technology plan that supports school improvement technology
 13 21 efforts and includes an evaluation component.  The plan shall
 13 22 focus on the attainment of student achievement goals under
 13 23 sections 280.12 and 280.18 and shall demonstrate the manner in
 13 24 which the board, over a four-year period, will utilize
 13 25 technology to improve student achievement.  The plan shall be
 13 26 developed by licensed professional staff of the district,
 13 27 including both teachers and administrators.  The advisory
 13 28 committee appointed by the board pursuant to section 280.12,
 13 29 subsection 2, shall advise the board concerning the
 13 30 development of goals and the assessment process and
 13 31 measurements to be used under the plan.  Technology plans
 13 32 shall be kept on file in the district and a copy sent to the
 13 33 appropriate area education agency.  Progress made under these
 13 34 plans shall be included as part of the annual report submitted
 13 35 to the department of education in compliance with sections
 14  1 280.12 and 280.18.
 14  2    2.  The Iowa braille and sight saving school, the state
 14  3 school for the deaf, and the Price laboratory school at the
 14  4 university of northern Iowa shall develop a technology plan
 14  5 that supports and improves student achievement, demonstrates
 14  6 the manner in which technology will be utilized to improve
 14  7 student achievement, and includes an evaluation component.
 14  8 Plans and an annual progress report shall be submitted to the
 14  9 state board of regents and the department of education.
 14 10    Sec. 22.  NEW SECTION.  295.4  SCHOOL IMPROVEMENT AND
 14 11 TECHNOLOGY EXPENDITURES.
 14 12    Funds received by a school district pursuant to section
 14 13 295.2 shall be expended for communication costs, the
 14 14 acquisition, lease, or lease-purchase, installation, and
 14 15 maintenance of instructional technology equipment, including
 14 16 hardware and software, materials and supplies related to
 14 17 instructional technology, and staff development and training.
 14 18 Priorities for the use of the funds shall be made by the
 14 19 school district.  This section shall not be construed to
 14 20 prevent the board of directors of a school district in its
 14 21 discretion from using the funds received pursuant to section
 14 22 295.2 for staff development and training.  However, funds
 14 23 received by a school district pursuant to section 295.2 shall
 14 24 not be expended to add a full-time equivalent position or
 14 25 otherwise increase staffing.  
 14 26                           EXPLANATION
 14 27    Division I of this bill makes appropriations for the fiscal
 14 28 year beginning July 1, 1996, and ending June 30, 1997, to the
 14 29 state department of transportation from the general fund of
 14 30 the state, the road use tax fund, and the primary road fund.
 14 31    Division II of this bill makes appropriations from the
 14 32 rebuild Iowa infrastructure fund of the state for the fiscal
 14 33 year beginning July 1, 1996, and ending June 30, 1997, for
 14 34 capital projects for the board of regents, the department of
 14 35 corrections, the department of general services, the
 15  1 department of human services, the department of public
 15  2 defense, the department of public safety, the state department
 15  3 of transportation, the commission of veterans affairs, the
 15  4 Iowa communications network fund, and the Iowa state fair
 15  5 foundation.  In addition, the bill makes a general fund
 15  6 appropriation from marine fuel tax receipts to the department
 15  7 of natural resources.
 15  8    Division III of this bill amends section 8D.13 to provide
 15  9 that access be offered to the department of public safety and
 15 10 the department of public defense for the purpose of
 15 11 establishing and operating a shared data network providing law
 15 12 enforcement, emergency management, disaster service, emergency
 15 13 warning, and other emergency information dissemination
 15 14 services to federal, state, and local law enforcement
 15 15 agencies.
 15 16    Division IV of this bill makes appropriations to the
 15 17 department of education for school improvement technology.
