There is appropriated from the general fund of the 4 34 state to the college student aid commission for the fiscal 4 35 year beginning July 1, 1996, and ending June 30, 1997, the 5 1 following amounts, or so much thereof as may be necessary, to 5 2 be used for the purposes designated: 5 3 1. UNIVERSITY OF OSTEOPATHIC MEDICINE AND HEALTH SCIENCES 5 8 a. For the university of osteopathic medicine and health 5 13 sciences for an initiative in primary health care to direct 5 14 primary care physicians to shortage areas in the state: 5 15 .................................................. $ 395,000 5 16 The moneys appropriated in this lettered paragraph shall be 5 17 used as follows: 5 18 (1) To reduce student loan debt for primary care 5 19 physicians in an amount not to exceed $30,000 per student for 5 20 a four-year period of medical service in medically under- 5 21 served areas of the state. 5 22 (2) For tuition scholarships for students attending the 5 23 university of osteopathic medicine and health sciences who 5 24 agree to practice primary care medicine in medically under- 5 25 served areas of the state. The student shall practice in the 5 26 state two years for every year of tuition. A person receiving 5 27 funds under this subparagraph shall not be eligible for funds 5 28 under subparagraph (1). 5 29 (3) For general administration costs of the university for 5 30 the primary care initiative, the university shall expend an 5 31 amount not to exceed $50,000. 5 32 The university of osteopathic medicine and health sciences 5 33 shall report quarterly to the legislative fiscal bureau 5 34 concerning the expenditure of funds used pursuant to 5 35 subparagraphs (1), (2), and (3) of this lettered paragraph. 6 1 The university shall also submit the annual audit of the 6 2 university to the legislative fiscal bureau within six months 6 3 following the year being audited. The college student aid 6 4 commission shall not provide moneys for subparagraphs (1) and 6 5 (2) of this lettered paragraph until the university has signed 6 6 and submitted contracts for the use of these moneys for 6 7 reduction of student loan debt and tuition scholarships. 6 8 Funds for subparagraph (3) of this lettered paragraph shall be 6 9 provided quarterly to the university. Notwithstanding section 6 10 8.33, the funds for this lettered paragraph shall not revert 6 11 to the general fund but be available for expenditure the 6 12 following fiscal year for purposes of subparagraphs (1) and 6 13 (2). 6 14 3. STUDENT AID PROGRAMS 6 15 a. For payments to students for the Iowa grant program: 6 16 .................................................. $ 1,397,790 6 17 The moneys appropriated in this lettered paragraph for the 6 18 fiscal year beginning July 1, 1996, and ending June 30, 1997, 6 19 shall be expended for an Iowa grant program, with funds to be 6 20 allocated to institutions pursuant to section 261.93A. 6 21 b. For enhanced forgiveable loans: 6 22 .................................................. $ 115,000 6 23 The amount of an enhanced forgiveable loan shall not exceed 6 24 $11,500. To qualify for a loan a person shall: 6 25 (1) Be required to practice primary care in a community 6 26 designated as underserved by state and federal authorities and 6 27 having a population of less than 20,000. A student must 6 28 provide one year of practice for every year of loan 6 29 forgiveness. 6 30 (2) Have shown superior academic achievement and 6 31 demonstrated exceptional financial need during the last year 6 32 of undergraduate study. 6 33 The commission shall prescribe by rule the terms of 6 34 repayment and forgiveness. The rules shall be consistent with 6 35 the requirements of section 261.19A. The commission shall 7 1 deposit payments made by loan recipients into the fund created 7 2 in section 261.19B. 7 3 Sec. 3. There is appropriated from the loan reserve 7 4 account to the college student aid commission for the fiscal 7 5 year beginning July 1, 1996, and ending June 30, 1997, the 7 6 following amount, or so much thereof as may be necessary, to 7 7 be used for the purposes designated: 7 8 For operating costs of the Stafford loan program including 7 9 salaries, support, maintenance, and miscellaneous purposes: 7 10 .................................................. $ 4,696,739 7 11 Sec. 4. There is appropriated from the scholarship and 7 12 tuition grant reserve fund to the college student aid 7 13 commission for the fiscal year beginning July 1, 1996, and 7 14 ending June 30, 1997, the following amounts, or so much 7 15 thereof as may be necessary, to be used for the purposes 7 16 designated: 7 17 a. University hospitals 9 6 For salaries, general support, maintenance, equipment, and 9 7 miscellaneous purposes and for medical and surgical treatment 9 8 of indigent patients as provided in chapter 255: 9 9 .................................................. $ 29,452,383 9 10 The university of Iowa hospitals and clinics shall submit 9 11 quarterly a report regarding the portion of the appropriation 9 12 in this lettered paragraph expended on general support in a 9 13 format jointly developed by the university of Iowa hospitals 9 14 and clinics, the legislative fiscal bureau, and the department 9 15 of management which delineates the expenditures and purposes 9 16 of the funds. 9 17 Funds appropriated in this lettered paragraph shall not be 9 18 used to perform abortions except medically necessary 9 19 abortions, and shall not be used to operate the early 9 20 termination of pregnancy clinic except for the performance of 9 21 medically necessary abortions. For the purpose of this 9 22 lettered paragraph, an abortion is the purposeful interruption 9 23 of pregnancy with the intention other than to produce a live- 9 24 born infant or to remove a dead fetus, and a medically 9 25 necessary abortion is one performed under one of the following 9 26 conditions: 9 27 (1) The attending physician certifies that continuing the 9 28 pregnancy would endanger the life of the pregnant woman. 9 29 (2) The attending physician certifies that the fetus is 9 30 physically deformed, mentally deficient, or afflicted with a 9 31 congenital illness. 9 32 (3) The pregnancy is the result of a rape which is 9 33 reported within 45 days of the incident to a law enforcement 9 34 agency or public or private health agency which may include a 9 35 family physician. 10 1 (4) The pregnancy is the result of incest which is 10 2 reported within 150 days of the incident to a law enforcement 10 3 agency or public or private health agency which may include a 10 4 family physician. 10 5 (5) The abortion is a spontaneous abortion, commonly known 10 6 as a miscarriage, wherein not all of the products of 10 7 conception are expelled. 10 8 The total quota allocated to the counties for indigent 10 9 patients for the fiscal year beginning July 1, 1996, shall not 10 10 be lower than the total quota allocated to the counties for 10 11 the fiscal year commencing July 1, 1995. The total quota 10 12 shall be allocated among the counties on the basis of the 1990 10 13 census pursuant to section 255.16. 10 14 d. Such costs charged to these departments shall not 14 16 exceed the expenses incurred in conducting the approved 14 17 research. 14 18 Sec. 6. Reallocations of sums received under section 5, 14 19 subsections 2, 3, 4, 5, and 6, of this Act, including sums 14 20 received for salaries, shall be reported on a quarterly basis 14 21 to the co-chairpersons and ranking members of the legislative 14 22 fiscal committee and the joint appropriations subcommittee on 14 23 education. 14 24 Sec. 7. MEDICAL ASSISTANCE – SUPPLEMENTAL AMOUNTS. For 14 25 the fiscal year beginning July 1, 1996, and ending June 30, 14 26 1997, the department of human services shall continue the 14 27 supplemental disproportionate share and a supplemental 14 28 indirect medical education adjustment applicable to state- 14 29 owned acute care hospitals with more than 500 beds and shall 14 30 reimburse qualifying hospitals pursuant to that adjustment 14 31 with a supplemental amount for services provided medical 14 32 assistance recipients. The adjustment shall generate 14 33 supplemental payments intended to equal the state 14 34 appropriation made to a qualifying hospital for treatment of 14 35 indigent patients as provided in chapter 255. To the extent 15 1 of the supplemental payments, a qualifying hospital shall, 15 2 after receipt of the funds, transfer to the department of 15 3 human services an amount equal to the actual supplemental 15 4 payments that were made in that month. The aggregate amounts 15 5 for the fiscal year shall not exceed the state appropriation 15 6 made to the qualifying hospital for treatment of indigent 15 7 patients as provided in chapter 255. The department of human 15 8 services shall deposit the portion of these funds equal to the 15 9 state share in the department's medical assistance account and 15 10 the balance shall be credited to the general fund of the 15 11 state. To the extent that state funds appropriated to a 15 12 qualifying hospital for the treatment of indigent patients as 15 13 provided in chapter 255 have been transferred to the 15 14 department of human services as a result of these supplemental 15 15 payments made to the qualifying hospital, the department shall 15 16 not, directly or indirectly, recoup the supplemental payments 15 17 made to a qualifying hospital for any reason, unless an 15 18 equivalent amount of the funds transferred to the department 15 19 of human services by a qualifying hospital pursuant to this 15 20 provision is transferred to the qualifying hospital by the 15 21 department. 15 22 If the state supplemental amount allotted to the state of 15 23 Iowa for the federal fiscal year beginning October 1, 1996, 15 24 and ending September 30, 1997, pursuant to section 1923 (f)(3) 15 25 of the federal Social Security Act, as amended, or pursuant to 15 26 federal payments for indirect medical education is greater 15 27 than the amount necessary to fund the federal share of the 15 28 supplemental payments specified in the preceding paragraph, 15 29 the department of human services shall increase the 15 30 supplemental disproportionate share or supplemental indirect 15 31 medical education adjustment by the lesser of the amount 15 32 necessary to utilize fully the state supplemental amount or 15 33 the amount of state funds appropriated to the state university 15 34 of Iowa general education fund and allocated to the university 15 35 for the college of medicine. The state university of Iowa 16 1 shall transfer from the allocation for the college of medicine 16 2 to the department of human services, on a monthly basis, an 16 3 amount equal to the additional supplemental payments made 16 4 during the previous month pursuant to this paragraph. A 16 5 qualifying hospital receiving supplemental payments pursuant 16 6 to this paragraph that are greater than the state 16 7 appropriation made to the qualifying hospital for treatment of 16 8 indigent patients as provided in chapter 255 shall be 16 9 obligated as a condition of its participation in the medical 16 10 assistance program to transfer to the state university of Iowa 16 11 general education fund on a monthly basis an amount equal to 16 12 the funds transferred by the state university of Iowa to the 16 13 department of human services. To the extent that state funds 16 14 appropriated to the state university of Iowa and allocated to 16 15 the college of medicine have been transferred to the 16 16 department of human services as a result of these supplemental 16 17 payments made to the qualifying hospital, the department shall 16 18 not, directly or indirectly, recoup these supplemental 16 19 payments made to a qualifying hospital for any reason, unless 16 20 an equivalent amount of the funds transferred to the 16 21 department of human services by the state university of Iowa 16 22 pursuant to this paragraph is transferred to the qualifying 16 23 hospital by the department. 16 24 Continuation of the supplemental disproportionate share and 16 25 supplemental indirect medical education adjustment shall 16 26 preserve the funds available to the university hospital for 16 27 medical and surgical treatment of indigent patients as 16 28 provided in chapter 255 and to the state university of Iowa 16 29 for educational purposes at the same level as provided by the 16 30 state funds initially appropriated for that purpose. 16 31 The department of human services shall, in any compilation 16 32 of data or other report distributed to the public concerning 16 33 payments to providers under the medical assistance program, 16 34 set forth reimbursements to a qualifying hospital through the 16 35 supplemental disproportionate share and supplemental indirect 17 1 medical education adjustment as a separate item and shall not 17 2 include such payments in the amounts otherwise reported as the 17 3 reimbursement to a qualifying hospital for services to medical 17 4 assistance recipients. 17 5 For purposes of this section, "supplemental payment" means 17 6 a supplemental payment amount paid for medical assistance to a 17 7 hospital qualifying for that payment under this section. 17 8 Sec. 8. Notwithstanding section 8.33, funds appropriated 17 9 in 1995 Iowa Acts, chapter 218, section 6, subsection 1, 17 10 paragraph "b", remaining unencumbered or unobligated on June 17 11 30, 1996, shall not revert to the general fund of the state 17 12 but shall be available for expenditure for the purposes listed 17 13 in section 5, subsection 1, paragraph "b", of this Act during 17 14 the fiscal year beginning July 1, 1996, and ending June 30, 17 15 1997. 17 16 DEPARTMENT OF CULTURAL AFFAIRS 17 17 Sec. 9. There is appropriated from the general fund of the 17 18 state to the department of cultural affairs for the fiscal 17 19 year beginning July 1, 1996, and ending June 30, 1997, the 17 20 following amounts, or so much thereof as is necessary, to be 17 21 used for the purposes designated: 17 22 1. ARTS DIVISION 17 23 For salaries, support, maintenance, and miscellaneous 17 24 purposes, including funds to match federal grants, for 17 25 areawide arts and cultural service organizations that meet the 17 26 requirements of chapter 303C: 17 27 .................................................. $ 1,061,568 17 28 2. There is appropriated from the general fund of 18 15 the state to the Iowa communications network fund under 18 16 control of the Iowa telecommunications and technology 18 17 commission for the fiscal year beginning July 1, 1996, and 18 18 ending June 30, 1997, the following amount, or so much thereof 18 19 as is necessary, to be used for the purposes designated: 18 20 OPERATIONS 18 21 For salaries, support, maintenance, and miscellaneous 18 22 purposes, and for the subsidization of video rates for 18 23 authorized users as determined by the commission and 18 24 consistent with chapter 8D: 18 25 .................................................. $ 2,400,000 18 26 Sec. 11. There is appropriated from the general fund of 18 27 the state to the Iowa communications network fund under 18 28 control of the Iowa telecommunications and technology 18 29 commission for the fiscal year beginning July 1, 1996, and 18 30 ending June 30, 1997, the following amount, or so much thereof 18 31 as may be necessary, to be used for the purpose designated: 18 32 For debt service: 18 33 .................................................. $ 12,754,000 18 34 Upon the appropriation of the funds in this section to the 18 35 Iowa communications network fund, the Iowa telecommunications 19 1 and technology commission shall immediately transfer 19 2 $12,754,000 of the appropriated amount to a separate fund 19 3 established in the office of the treasurer of state, to be 19 4 used solely for debt service for the Iowa communications 19 5 network. The commission shall certify to the treasurer of 19 6 state when a debt service payment is due and upon receipt of 19 7 the certification the treasurer shall make the payment. The 19 8 commission shall pay any additional amount due from funds 19 9 deposited in the Iowa communications network fund. 19 10 Sec. 12. There is appropriated from the general fund of 19 11 the state to the Iowa communications network fund under the 19 12 control of the Iowa telecommunications and technology 19 13 commission for the fiscal year beginning July 1, 1996, and 19 14 ending June 30, 1997, the following amount, or so much thereof 19 15 as is necessary, to be used for the purposes designated: 19 16 For purposes designated in subsections 1 and 2: 19 17 .................................................. $ 1,950,000 19 18 1. As a condition of the appropriation in this section, 19 19 $450,000 of the amount appropriated shall be expended by the 19 20 public broadcasting division of the department of education to 19 21 provide support for functions related to the network, 19 22 including but not limited to the following functions: 19 23 scheduling for video classrooms; design, preparation, and 19 24 support of interactive classrooms; development of a central 19 25 information source on Internet relating to the network; and 19 26 coordinating the work of the education telecommunications 19 27 council. 19 28 2. As a further condition of the appropriation in this 19 29 section, $1,500,000 of the amount appropriated shall be 19 30 allocated by the public broadcasting division of the 19 31 department of education to the regional telecommunications 19 32 councils established in section 8D.5. The regional 19 33 telecommunications councils, with assistance from the 19 34 department of education, shall use the funds to provide direct 19 35 staff development for educators, staff development for 20 1 educational uses of Internet and other on-line services, 20 2 technical assistance for network classrooms, and other related 20 3 activities. 20 4 Sec. 13. Notwithstanding the limitation on the use of 20 5 moneys in the interest for Iowa school fund in section 20 6 257B.1A, any unobligated or unemcumbered moneys in the 20 7 interest for Iowa school fund on June 30, 1996, shall be 20 8 transferred to the department of education for the fiscal year 20 9 beginning July 1, 1996, and ending June 30, 1997, the 20 10 following amounts, or so much thereof as is necessary, to be 20 11 used for the purposes designated: 20 12 1. Character education: 20 13 .................................................. $ 35,000 20 14 2. Iowa math and science coalition: 20 15 .................................................. $ 25,000 20 16 3. Local arts comprehensive educational strategies 20 17 (LACES): 20 18 .................................................. $ 65,000 20 19 Sec. 14. Notwithstanding the standing appropriation in 20 20 section 279.51, subsection 1, there is appropriated under 20 21 section 279.51, subsection 1, for the fiscal year beginning 20 22 July 1, 1996, and ending June 30, 1997, the sum of 20 23 $14,119,216. 20 24 Sec. 15. Notwithstanding the appropriation in section 20 25 294A.25, there is appropriated under section 294A.25 for the 20 26 fiscal year beginning July 1, 1996, and ending June 30, 1997, 20 27 the sum of $81,476,336. 20 28 1. For the fiscal year beginning July 1, 1996, and ending 20 29 June 30, 1997, the amount of $150,000 is to be paid to the 20 30 department of education from additional funds transferred from 20 31 phase I to phase III for development of a K-12 and community 20 32 college management information system. If funds available 20 33 from the specified sources are insufficient to fully fund the 20 34 appropriation, the amount appropriated to the department under 20 35 this subsection shall be reduced to an amount equal to the 21 1 available funds. 21 2 2. For the fiscal year beginning July 1, 1996, and ending 21 3 June 30, 1997, up to $46,000 from additional funds transferred 21 4 from phase I to phase III is to be paid to the department of 21 5 education for matching grants for teachers who select to 21 6 participate in the national board for professional teaching 21 7 standards process. One thousand dollars per teacher will be 21 8 available toward the cost of the certification process to be 21 9 matched by the teacher or by the teacher's school district. 21 10 Sec. 16. There is appropriated from the general fund of 21 11 the state to the department of education for the fiscal year 21 12 beginning July 1, 1996, and ending June 30, 1997, the 21 13 following amount, or so much thereof as is necessary, to be 21 14 used for the purpose designated: 21 15 To supplement phase II of the educational excellence 21 16 program: 21 17 .................................................. $ 5,000 21 18 Sec. 17. There is appropriated from the general fund of 21 19 the state to the department of education for the fiscal year 21 20 beginning July 1, 1996, and ending June 30, 1997, the 21 21 following amount, or so much thereof as is necessary, to be 21 22 used for the purpose designated: 21 23 To provide matching funds to the school districts to pay 21 24 for health benefits covering early retirement of classroom 21 25 teachers under section 279.46: 21 26 .................................................. $ 500,000 21 27 The match shall consist of one-third from the state, one- 21 28 third from the school district, and one-third from the 21 29 employee who elects early retirement pursuant to a program 21 30 adopted pursuant to section 279.46 which program provides for 21 31 the continuation of health or medical insurance coverage. 21 32 Sec. 18. Section 261.12, subsection 1, paragraph b, Code 21 33 Supplement 1995, is amended to read as follows: 21 34 b. For the fiscal year beginning July 1,19951996, and 21 35 for each following fiscal year,twothree thousandnineone 22 1 hundred fifty dollars. If additional funds become available 22 2 for distribution, the commission shall increase the amount 22 3 specified in this paragraph. 22 4 Sec. 19. Section 261.25, subsection 1, Code Supplement 22 5 1995, is amended to read as follows: 22 6 1. There is appropriated from the general fund of the 22 7 state to the commission for each fiscal year the sum of 22 8thirty-fivethirty-eight million six hundred sixty-four 22 9 thousand seven hundred fifty dollars for tuition grants. 22 10 Sec. 20. Section 294A.5, Code 1995, is amended to read as 22 11 follows: 22 12 294A.5 MINIMUM SALARY SUPPLEMENT. 22 13 For the school year beginning July 1,19871996, and 22 14 succeeding school years, the minimum annual salary paid to a 22 15 full-time teacher as regular compensation shall beeighteen22 16 twenty thousand dollars. 22 17 For the school year beginning July 1,19871996, for phase 22 18 I, each school district and area education agency shall 22 19 certify to the department of education by the third Friday in 22 20 September the names of all teachers employed by the district 22 21 or area education agency whose regular compensation is less 22 22 thaneighteentwenty thousand dollars per year for that year 22 23 and the amounts needed as minimum salary supplements. The 22 24 minimum salary supplement for each eligible teacher is the 22 25 total of the difference betweeneighteentwenty thousand 22 26 dollars and the teacher's regular compensation plus the amount 22 27 required to pay the employer's share of the federal social 22 28 security and Iowa public employees' retirement system, or a 22 29 pension and annuity retirement system established under 22 30 chapter 294, payments on the additional salary moneys. 22 31 The board of directors shall report the salaries of 22 32 teachers employed on less than a fulltime equivalent basis, 22 33 and the amount of minimum salary supplement shall be prorated. 22 34 Sec. 21. Section 294A.6, unnumbered paragraph 2, Code 22 35 1995, is amended to read as follows: 23 1 If the moneys allocated for phase I for a school year 23 2 exceed the moneys required to pay the total minimum salary 23 3 supplements to all school districts and area education 23 4 agencies, the board of directors of a school district that has 23 5 employed one or more additional teachers as a result of a 23 6 whole grade sharing agreement completed under section 282.7 23 7 may request approval from the department of education for 23 8 additional funding for its minimum salary supplement for that 23 9 school year and succeeding school years if the other school 23 10 district or districts that are parties to the sharing 23 11 agreement have correspondingly reduced their number of 23 12 teachers. If the department of education approves the payment 23 13 of the additional salary supplement to a district, the 23 14 department shall certify to the department of revenue and 23 15 finance that the additional payment be made. The payment 23 16 shall be equal to the amount of the difference between 23 17eighteentwenty thousand dollars and the teacher's regular 23 18 compensation, plus the amount required to make the payments on 23 19 the additional salary moneys for the employer's share of the 23 20 federal social security and Iowa public employees' retirement 23 21 system, or a pension and annuity retirement system established 23 22 under chapter 294. If the phase I moneys remaining are 23 23 insufficient to pay the entire amount approved by the 23 24 department of education, the department of revenue and finance 23 25 shall prorate the payments to school districts. 23 26 Sec. 22. Section 294A.25, subsection 8, Code Supplement 23 27 1995, is amended to read as follows: 23 28 8. For the fiscal year beginning July 1,19951996, to the 23 29 department of education from phase III moneys the amount of 23 30 one million two hundred fifty thousand dollars for support for 23 31 the operations of the new Iowa schools development corporation 23 32 and for school transformation design and implementation 23 33 projects administered by the corporation. Of the amount 23 34 provided in this subsection, one hundred fifty thousand 23 35 dollars shall be used for the school and community planning 24 1 initiative. 24 2 Sec. 23. Sections 8 and 13 of this Act, being deemed of 24 3 immediate importance, take effect upon enactment. 24 4 EXPLANATION 24 5 This bill makes appropriations for the 1996-1997 fiscal 24 6 year to the department of education, the college student aid 24 7 commission, the state board of regents, the department of 24 8 cultural affairs, and the Iowa communications network fund. 24 9 The bill increases the minimum annual salary paid in 24 10 regular compensation to a full-time teacher from $18,000 to 24 11 $20,000. 24 12 This bill provides an effective date. 24 13 LSB 3216XG 76 24 14 mg/jj/8.4
