  1  2    Section 1.  GENERAL APPROPRIATION.  There is appropriated
  1  3 from the general fund of the state to the department of
  1  4 agriculture and land stewardship for the fiscal year beginning
  1  5 July 1, 1996, and ending June 30, 1997, the following amounts,
  1  6 or so much thereof as is necessary, to be used for the
  1  7 purposes designated:
  1  8    1.  ADMINISTRATIVE DIVISION
  1  9    a.  For salaries, support, maintenance, the support of the
  1 10 state 4-H foundation, support of the statistics bureau, and
  1 11 miscellaneous purposes:  
  1 12 .................................................. $  1,659,111
  1 13    b.  For the operations of the dairy trade practices bureau:  
  1 14 .................................................. $     66,846
  1 15    c.  For the purpose of performing commercial feed audits:

  1 19    2.  REGULATORY DIVISION
  1 20    a.  For salaries, support, maintenance, and miscellaneous

  1 23    b.  For the costs of inspection, sampling, analysis, and
  1 24 other expenses necessary for the administration of chapters
  1 25 192, 194, and 195:

  1 27    3.  LABORATORY DIVISION
  1 28    a.  For salaries, support, maintenance, and miscellaneous
  1 29 purposes, including the administration of the gypsy moth
  1 30 program:

  1 32    b.  For the operations of the commercial feed programs:

  1 34    c.  For the operations of the pesticide programs:

  2  3    4.  SOIL CONSERVATION DIVISION
  2  4    a.  For salaries, support, maintenance, assistance to soil
  2  5 conservation districts, and miscellaneous purposes:  
  2  6 .................................................. $  5,805,591
  2  7    Of the amount appropriated in this paragraph "a", $330,000
  2  8 shall be used to reimburse commissioners of soil and water
  2  9 conservation districts for administrative expenses.  Moneys
  2 10 used for the payment of meeting dues by counties shall be
  2 11 matched on a dollar-for-dollar basis by the soil conservation
  2 12 division.
  2 13    b.  To provide financial incentives for soil conservation
  2 14 practices under chapter 161A:  
  2 15 .................................................. $  5,918,606
  2 16    c.  The following requirements apply to the moneys
  2 17 appropriated in paragraph "b":
  2 18    (1)  Not more than 5 percent of the moneys appropriated in
  2 19 paragraph "b" may be allocated for cost sharing to abate
  2 20 complaints filed under section 161A.47.
  2 21    (2)  Of the moneys appropriated in paragraph "b", 5 percent
  2 22 shall be allocated for financial incentives to establish
  2 23 practices to protect watersheds above publicly owned lakes of
  2 24 the state from soil erosion and sediment as provided in
  2 25 section 161A.73.
  2 26    (3)  Not more than 30 percent of a district's allocation of
  2 27 moneys as financial incentives may be provided for the purpose
  2 28 of establishing management practices to control soil erosion
  2 29 on land that is row cropped, including but not limited to no-
  2 30 till planting, ridge-till planting, contouring, and contour
  2 31 strip-cropping as provided in section 161A.73.
  2 32    (4)  The state soil conservation committee created in
  2 33 section 161A.4 may allocate moneys to conduct research and
  2 34 demonstration projects to promote conservation tillage and
  2 35 nonpoint source pollution control practices.
  3  1    (5)  The financial incentive payments may be used in
  3  2 combination with department of natural resources moneys.
  3  3    d.  The provisions of section 8.33 shall not apply to the
  3  4 moneys appropriated in paragraph "b".  Unencumbered or
  3  5 unobligated moneys remaining on June 30, 2000, from moneys
  3  6 appropriated in paragraph "b" for the fiscal year beginning
  3  7 July 1, 1996, shall revert to the general fund on August 31,
  3  8 2000.
  3  9    Sec. 2.  FARMERS' MARKET COUPON PROGRAM.  There is
  3 10 appropriated from the general fund of the state to the
  3 11 department of agriculture and land stewardship for the fiscal
  3 12 year beginning July 1, 1996, and ending June 30, 1997, the
  3 13 following amount, or so much thereof as is necessary, to be
  3 14 used for the purposes designated:
  3 15    For salaries, support, maintenance, and miscellaneous
  3 16 purposes, to be used by the department to continue the
  3 17 farmers' market coupon program by providing federal special
  3 18 supplemental food program recipients with coupons redeemable
  3 19 at farmers' markets:  
  3 20 .................................................. $    215,807
  3 21    Sec. 3.  PSEUDORABIES ERADICATION PROGRAM.  There is
  3 22 appropriated from the general fund of the state to the
  3 23 department of agriculture and land stewardship for the fiscal
  3 24 year beginning July 1, 1996, and ending June 30, 1997, the
  3 25 following amount, or so much thereof as is necessary, to be
  3 26 used for the purpose designated:
  3 27    For support of the pseudorabies eradication program:  
  3 28 .................................................. $    900,200
  3 29    Sec. 4.  HORSE AND DOG RACING.  There is appropriated from
  3 30 the moneys available under section 99D.13 to the regulatory
  3 31 division of the department of agriculture and land stewardship
  3 32 for the fiscal year beginning July 1, 1996, and ending June
  3 33 30, 1997, the following amount, or so much thereof as is
  3 34 necessary, to be used for the purposes designated:
  3 35    For salaries, support, maintenance, and miscellaneous
  4  1 purposes for the administration of section 99D.22:  
  4  2 .................................................. $    192,560
  4  3    Sec. 5.  INTERSTATE COMPACT ON AGRICULTURAL GRAIN
  4  4 MARKETING.  There is appropriated from the general fund of the
  4  5 state to the interstate agricultural grain marketing
  4  6 commission for the fiscal year beginning July 1, 1996, and
  4  7 ending June 30, 1997, the following amount, or so much thereof
  4  8 as is necessary, to be used for the purpose designated:
  4  9    For carrying out duties of the commission as provided in
  4 10 Article IV of the interstate compact on agricultural grain
  4 11 marketing as provided in chapter 183:  
  4 12 .................................................. $     80,000
  4 13                 DEPARTMENT OF NATURAL RESOURCES
  4 14    Sec. 6.  GENERAL APPROPRIATION.  There is appropriated from
  4 15 the general fund of the state to the department of natural
  4 16 resources for the fiscal year beginning July 1, 1996, and
  4 17 ending June 30, 1997, the following amounts, or so much
  4 18 thereof as is necessary, to be used for the purposes
  4 19 designated:
  4 20    1.  OPERATIONS
  4 21    For salaries, support, maintenance, and miscellaneous
  4 22 purposes:  
  4 23 .................................................. $ 13,482,022
  4 24    2.  WATER QUALITY PROTECTION FUND
  4 25    For allocation to the water quality protection fund
  4 26 established pursuant to section 455B.183A, to carry out the
  4 27 purposes of that fund:  
  4 28 .................................................. $    729,000
  4 29    Sec. 7.  STATE FISH AND GAME PROTECTION FUND –
  4 30 APPROPRIATION TO THE DIVISION OF FISH AND WILDLIFE.
  4 31    1.  There is appropriated from the state fish and game
  4 32 protection fund to the division of fish and wildlife of the
  4 33 department of natural resources for the fiscal year beginning
  4 34 July 1, 1996, and ending June 30, 1997, the following amount,
  4 35 or so much thereof as is necessary, to be used for the
  5  1 purposes designated:
  5  2    For administrative support, and for salaries, support,
  5  3 maintenance, equipment, and miscellaneous purposes:  
  5  4 .................................................. $ 21,165,891
  5  5    2.  The department shall not expend more moneys from the
  5  6 fish and game protection fund than provided in this section,
  5  7 unless the expenditure derives from contributions made by a
  5  8 private entity, or a grant or moneys received from the federal
  5  9 government, and is approved by the natural resource
  5 10 commission.  The department of natural resources shall
  5 11 promptly notify the legislative fiscal bureau and the
  5 12 chairpersons and ranking members of the joint appropriations
  5 13 subcommittee on agriculture and natural resources concerning
  5 14 the commission's approval.
  5 15    Sec. 8.  MARINE FUEL TAX RECEIPTS – CAPITALS AND BOATING
  5 16 FACILITIES AND ACCESS.  There is appropriated from the marine
  5 17 fuel tax receipts deposited in the general fund of the state
  5 18 to the department of natural resources for the fiscal year
  5 19 beginning July 1, 1996, and ending June 30, 1997, the
  5 20 following amounts, or so much thereof as is necessary, to be
  5 21 used for the purposes designated:
  5 22    1.  For purposes of maintaining and developing boating
  5 23 facilities and access to public waters by the parks and
  5 24 preserves division:  
  5 25 .................................................. $    411,311
  5 26    2.  For the purpose of funding capital projects
  5 27 traditionally funded from marine fuel tax receipts for the
  5 28 purposes specified in section 452A.79 and for expenditures,
  5 29 not necessarily capital expenditures, and for local cost share
  5 30 grants to local governmental units for boating accessibility:  
  5 31 .................................................. $  1,800,000
  5 32    Of the amount appropriated in this subsection, up to
  5 33 $200,000 may be used for expenditure purposes for local cost
  5 34 share grants to local governmental units for boating
  5 35 accessibility.
  6  1    3.  Notwithstanding section 8.33, the unencumbered or
  6  2 unobligated moneys remaining on June 30, 1997, from moneys
  6  3 appropriated in subsection 2, may be expended during the
  6  4 fiscal year beginning July 1, 1997, and ending June 30, 1998,
  6  5 and shall not revert to the general fund until August 31,
  6  6 1998.
  6  7    Sec. 9.  SNOWMOBILE FEES – TRANSFER FOR ENFORCEMENT
  6  8 PURPOSES.  There is transferred on July 1, 1996, from the fees
  6  9 deposited under section 321G.7 to the fish and game protection
  6 10 fund and appropriated to the department of natural resources
  6 11 for the fiscal year beginning July 1, 1996, and ending June
  6 12 30, 1997, the following amount, or so much thereof as is
  6 13 necessary, to be used for the purpose designated:
  6 14    For the purpose of enforcing snowmobile laws as part of the
  6 15 state snowmobile program administered by the department of
  6 16 natural resources:  
  6 17 .................................................. $    100,000
  6 18    Sec. 10.  VESSEL FEES – TRANSFER FOR ENFORCEMENT PURPOSES.
  6 19 There is transferred on July 1, 1996, from the fees deposited
  6 20 under section 462A.52 to the fish and game protection fund and
  6 21 appropriated to the department of natural resources for the
  6 22 fiscal year beginning July 1, 1996, and ending June 30, 1997,
  6 23 the following amount, or so much thereof as is necessary, to
  6 24 be used for the purpose designated:
  6 25    For purposes of administration and enforcement of
  6 26 navigation laws and water safety:  
  6 27 .................................................. $  1,200,000
  6 28                 ANIMAL INDUSTRY APPROPRIATIONS
  6 29    Sec. 11.  LIVESTOCK PRODUCERS ASSISTANCE.
  6 30    1.  There is appropriated from the general fund of the
  6 31 state to Iowa state university of science and technology, for
  6 32 the fiscal year beginning July 1, 1996, and ending June 30,
  6 33 1997, the following amount, or so much thereof as is
  6 34 necessary, to be used for the purposes designated:
  6 35    For the administration of the livestock producers
  7  1 assistance program established pursuant to section 266.39D,
  7  2 including salaries, support, maintenance, and miscellaneous
  7  3 purposes:  
  7  4 .................................................. $    276,022
  7  5    2.  The provisions of section 8.33 shall not apply to the
  7  6 moneys appropriated in this section.  Unencumbered or
  7  7 unobligated moneys remaining on June 30, 2000, from moneys
  7  8 appropriated in this section for the fiscal year beginning
  7  9 July 1, 1996, shall revert to the general fund on August 31,
  7 10 2000.  
  7 11                     RELATED APPROPRIATIONS
  7 12    Sec. 12.  TRANSFERS OF MONEYS REQUIRED TO BE DEPOSITED IN
  7 13 THE WATER PROTECTION FUND.  Notwithstanding section 161C.4 and
  7 14 the reversion and allocation provisions in section 455A.19,
  7 15 subsection 1, paragraph "c", of the unencumbered and
  7 16 unobligated moneys remaining on the effective date of this
  7 17 section, which are required to be deposited in the water
  7 18 protection fund created pursuant to section 161C.4, as
  7 19 provided in section 455A.19, subsection 1, paragraph "c", the
  7 20 following amounts shall be transferred first from moneys
  7 21 required to be deposited in the water protection practices
  7 22 account, and if necessary from moneys required to be deposited
  7 23 in the water quality protection projects account, which shall
  7 24 be used for the following purpose:
  7 25    To the Loess Hills development and conservation authority,
  7 26 for deposit in the Loess Hills development and conservation
  7 27 fund created in section 161D.2 for the purposes specified in
  7 28 section 161D.1:  
  7 29 .................................................. $    400,000
  7 30    Sec. 13.  REVENUE ADMINISTERED BY THE IOWA COMPREHENSIVE
  7 31 UNDERGROUND STORAGE TANK FUND BOARD – TRANSFER.  There is
  7 32 appropriated from the unassigned revenue fund administered by
  7 33 the Iowa comprehensive underground storage tank fund board, to
  7 34 the department of natural resources for the fiscal year
  7 35 beginning July 1, 1996, and ending June 30, 1997, the
  8  1 following amount, or so much thereof as is necessary, to be
  8  2 used for the purpose designated:
  8  3    For administration expenses of the underground storage tank
  8  4 section of the department of natural resources:  
  8  5 .................................................. $     75,000
  8  6    Sec. 14.  TRANSFER FROM ORGANIC NUTRIENT MANAGEMENT FUND.
  8  7 Notwithstanding sections 161C.5 and 161C.6, up to $500,000
  8  8 shall be transferred from the organic nutrient management fund
  8  9 during the fiscal year beginning July 1, 1996, to the Iowa
  8 10 state university of science and technology to be used for odor
  8 11 control applications of livestock confinement or animal
  8 12 feeding operations.  Moneys provided for odor control
  8 13 applications of livestock confinement or animal feeding
  8 14 operations shall be provided on a dollar-for-dollar match and
  8 15 shall not exceed the amount actually spent by or on behalf of
  8 16 the owner or operator for odor control.  
  8 17                          CODE CHANGES
  8 18    Sec. 15.  Section 15.201, Code 1995, is amended by adding
  8 19 the following new subsection:
  8 20    NEW SUBSECTION.  8.  Beginning July 1, 1996, the department
  8 21 shall have primary responsibility for the international
  8 22 marketing of agricultural products.
  8 23    Sec. 16.  Section 159.20, Code 1995, is amended by adding
  8 24 the following new subsection:
  8 25    NEW SUBSECTION.  11.  Beginning July 1, 1996, all functions
  8 26 and duties of the department relating to the international
  8 27 marketing of agricultural products shall cease to be the
  8 28 primary responsibility of the department but shall be the
  8 29 primary responsibility of the department of economic
  8 30 development.  This subsection does not prohibit the department
  8 31 from providing assistance requested by the department of
  8 32 economic development.
  8 33    Sec. 17.  Section 455A.18, subsection 3, unnumbered
  8 34 paragraph 1, Code 1995, is amended to read as follows:
  8 35    For each fiscal year of the fiscal period beginning July 1,
  9  1 1990 1996, and ending June 30, 2001 2021, there is
  9  2 appropriated from the general fund, to the Iowa resources
  9  3 enhancement and protection fund, the amount of thirty nine
  9  4 million dollars, except that for the fiscal year beginning
  9  5 July 1, 1990, the amount is twenty million dollars, to be used
  9  6 as provided in this chapter.  However, in any fiscal year of
  9  7 the fiscal period, if moneys from the lottery are appropriated
  9  8 by the state to the fund, the amount appropriated under this
  9  9 subsection shall be reduced by the amount appropriated from
  9 10 the lottery.
  9 11    Sec. 18.  Section 455B.183A, subsection 2, paragraph b,
  9 12 Code Supplement 1995, is amended to read as follows:
  9 13    b.  The operation of a public water supply system,
  9 14 including any part of the system.  The commission shall adopt
  9 15 a fee schedule which shall be based on the total number of
  9 16 persons served by public water supply systems in this state.
  9 17 However, a public water supply system shall be assessed a fee
  9 18 of at least twenty-five dollars.  A public water supply system
  9 19 not owned or operated by a community and serving a transient
  9 20 population shall be assessed a fee of twenty-five dollars.
  9 21 The commission shall calculate all fees in the schedule to
  9 22 produce total revenues equaling three six hundred fifty
  9 23 seventy-five thousand dollars for each fiscal year, commencing
  9 24 with the fiscal year beginning July 1, 1995 1996, and ending
  9 25 June 30, 1996 1997.  For each fiscal year, one-half of the
  9 26 fees shall be deposited into the administration account and
  9 27 one-half of the fees shall be deposited into the public water
  9 28 supply system account.  By May 1 of each year, the department
  9 29 shall estimate the total revenue expected to be collected from
  9 30 the overpayment of fees, which are all fees in excess of the
  9 31 amount of the total revenues which are expected to be
  9 32 collected under the current fee schedule, and the total
  9 33 revenue expected to be collected from the payment of fees
  9 34 during the next fiscal year.  The commission shall adjust the
  9 35 fees if the estimate exceeds the amount of revenue required to
 10  1 be deposited in the fund pursuant to this paragraph.
 10  2    Sec. 19.  Section 483A.30, Code 1995, is repealed.  
 10  3                           EXPLANATION
 10  4    This bill appropriates moneys to the department of
 10  5 agriculture and land stewardship and the department of natural
 10  6 resources, including for administration of those agencies.
 10  7 The bill provides appropriations to support several programs,
 10  8 including the pseudorabies eradication program, inspections
 10  9 for horses and dogs, and provides support to the interstate
 10 10 compact on agricultural grain.
 10 11    The bill appropriates moneys from the general fund to
 10 12 support various divisions of the department of natural
 10 13 resources.  The bill appropriates moneys from the state fish
 10 14 and game protection fund and from marine fuel tax receipts.
 10 15 Moneys are transferred to the fish and game protection fund to
 10 16 support the enforcement of snowmobile and navigation laws.
 10 17 The bill reduces the standing appropriation to the resources
 10 18 enhancement and protection fund and extends the number of
 10 19 years for which the standing appropriation is to be made.
 10 20    The bill makes the department of economic development
 10 21 primarily responsible for the international marketing of
 10 22 agricultural products.  The bill increases the amount of the
 10 23 money to be raised and deposited into the water quality
 10 24 protection fund beginning with the 1996-1997 fiscal year.
