Senate Study Bill 2244

  1  1    Section 1.  Section 216A.2, unnumbered paragraph 1, Code
  1  2 Supplement 1995, is amended to read as follows:
  1  3    The governor shall appoint a director of the department of
  1  4 human rights, subject to confirmation by the senate.  The
  1  5 department director shall serve at the pleasure of the
  1  6 governor.  The department director shall be appointed annually
  1  7 by the governor from among those individuals who serve as
  1  8 administrators of each of the divisions of the department.
  1  9 The appointment shall rotate among the administrators such
  1 10 that an administrator shall not be appointed to be the
  1 11 department director for a second year until such time as each
  1 12 administrator has served as the director.  An administrator
  1 13 appointed to be the department director shall fulfill the
  1 14 responsibilities and duties of the department director in
  1 15 addition to the individual's responsibilities and duties as an
  1 16 administrator of a division.  The department director shall:
  1 17    Sec. 2.  REPEAL.  Section 216A.5, Code 1995, is repealed.  
  1 18                           EXPLANATION
  1 19    Section 1 of the bill provides that the director of the
  1 20 department of human rights shall be appointed annually by the
  1 21 governor from among those individuals who serve as
  1 22 administrators of each of the divisions of the department of
  1 23 human rights.  The appointment shall rotate among the
  1 24 administrators such that an administrator shall not be
  1 25 appointed to be the director for a second year until such time
  1 26 as each administrator has served as the director.  An
  1 27 administrator appointed to be the director shall fulfill the
  1 28 responsibilities and duties of the director in addition to the
  1 29 individual's responsibilities and duties as an administrator
  1 30 of a division.
  1 31    Existing law provides that the governor appoints the
  1 32 director and the administrators of each of the divisions of
  1 33 the department of human rights, except for the division of
  1 34 persons with disabilities, subject to confirmation by the
  1 35 senate.  The director and the administrators serve at the
  2  1 pleasure of the governor.  The administrator of the division
  2  2 of persons with disabilities is chosen by the commission of
  2  3 persons with disabilities whose members are appointed by the
  2  4 governor.
  2  5    Section 2 repeals the section of the Code which eliminates
  2  6 the department of human rights effective July 1, 1997.
