PAG LIN 1 1 Section 1. NEW SECTION. 147.162 HEALTH CARE PROVIDER 1 2 IDENTIFICATION BADGES. 1 3 1. As used in this section: 1 4 a. "Health care provider" means individuals licensed or 1 5 certified as identified in section 135.61, subsection 10, and 1 6 in addition students, instructors, and volunteers having 1 7 contact with patients or clients in a health care setting. 1 8 b. "Health care setting" means an institutional health 1 9 facility as defined in section 135.61, subsection 14, and in 1 10 addition any health-related establishment or service, 1 11 including physician clinics and office and in-home care 1 12 services, involving contact with patients or clients. 1 13 2. All health care providers, when having contact with 1 14 patients or clients, shall identify themselves through the use 1 15 of clearly visible name tags or badges. Each tag or badge 1 16 shall display identifying information concerning the identity 1 17 of the health care provider, including the provider's name, 1 18 profession, and title. Failure to wear an identification tag 1 19 or badge when having contact with patients or clients in a 1 20 health care setting constitutes unprofessional conduct subject 1 21 to a penalty as established by rule of the health care 1 22 provider's examining board. 1 23 3. The department shall establish a prototype tag or badge 1 24 for use as an example where health care providers have not 1 25 previously developed an identification tag or badge containing 1 26 substantially the same information as that required by this 1 27 section. The cost of developing an identification tag or 1 28 badge, and the determination of the particular form and style, 1 29 shall be the responsibility of the individual health care 1 30 provider and their employer or professional society or 1 31 organization. 1 32 4. The department shall adopt rules pursuant to chapter 1 33 17A to administer this section. 1 34 EXPLANATION 1 35 This bill requires that health care providers in contact 2 1 with patients or clients wear identification tags or badges 2 2 containing information concerning the health care provider's 2 3 name, profession, and title. Failure to wear the 2 4 identification tag or badge while providing health care 2 5 services involving patient or client contact constitutes 2 6 unprofessional conduct subject to penalty as established by 2 7 rule. The department of public health shall develop a 2 8 prototype tag or badge, but the responsibility for developing 2 9 and financing the cost of the actual tags or badges, and their 2 10 form and style where similar tags or badges are not already in 2 11 existence, rests with the health care provider's employer or 2 12 professional society or organization. 2 13 LSB 3557SC 76 2 14 rn/cf/24
