1 1 Section 1. ENVIRONMENTAL CRIMES INVESTIGATION AND
1 2 PROSECUTION – FUNDING. There is appropriated from the
1 3 environmental crime fund of the department of justice,
1 4 consisting of court-ordered fines and penalties awarded to the
1 5 department arising out of the prosecution of environmental
1 6 crimes, to the department of justice for the fiscal year
1 7 beginning July 1, 1996, and ending June 30, 1997, an amount
1 8 not exceeding $20,000 to be used by the department, at the
1 9 discretion of the attorney general, for the investigation and
1 10 prosecution of environmental crimes.
1 11 The expenditure of the funds appropriated in this section
1 12 is contingent upon receipt by the environmental crime fund of
1 13 the department of justice of an amount at least equal to the
1 14 appropriations made in this section and received from
1 15 contributions, court-ordered restitution as part of judgments
1 16 in criminal cases, and consent decrees entered into as part of
1 17 civil or regulatory enforcement actions. However, if the
1 18 funds received are in excess of $20,000, the excess funds
1 19 shall not be appropriated to the department of justice
1 20 pursuant to this section.
1 21 EXPLANATION
1 22 This bill provides for an appropriation to the department
1 23 of justice from awards to an environmental crime fund
1 24 established in the department arising out of environmental
1 25 crime prosecutions to be used for the prosecution and
1 26 investigation of environmental crimes.
