  1  1    Section 1.  PART III RELATED APPROPRIATIONS.
  1  2    1.  PART III AUTHORIZED USERS.
  1  3    a.  There is appropriated from the rebuild Iowa
  1  4 infrastructure fund of the state created in section 8.57,
  1  5 subsection 5, to the Iowa communications network fund under
  1  6 the control of the Iowa telecommunications and technology
  1  7 commission for the fiscal year beginning July 1, 1996, and
  1  8 ending June 30, 1997, the following amount, or so much thereof
  1  9 as is necessary, to be used for the purpose designated:
  1 10    For the connection of a minimum of 110 Part III authorized
  1 11 users as determined by the commission and communicated to the
  1 12 general assembly:  
  1 13 .................................................. $ 20,800,000
  1 14    b.  It is the intent of the general assembly that the
  1 15 connection of the authorized user sites pursuant to this
  1 16 subsection be awarded based upon the Part III contracts
  1 17 executed in 1995.
  1 18    c.  It is the intent of the general assembly that the
  1 19 appropriation provided for in this section and the connections
  1 20 to be made with that appropriation represent the second phase
  1 21 of contracts, the total cost of which is anticipated to be
  1 22 approximately $94,690,000.  It is intended that the first four
  1 23 years of the plan include the connection of a minimum of 474
  1 24 Part III authorized users.  It is anticipated that the total
  1 25 cost of connections to be completed in the first four years of
  1 26 the plan which are to be funded by the general assembly
  1 27 through the rebuild Iowa infrastructure account of the state
  1 28 created in section 8.57, subsection 5, is to be approximately
  1 29 $80,880,000 with additional lease costs to be incurred in
  1 30 years five through eight of approximately $13,810,000.  The
  1 31 costs identified in this paragraph include all maintenance
  1 32 costs associated with state-owned hardware, a three percent
  1 33 increase for inflation in fiscal year 1997-1998, and a six
  1 34 percent increase for inflation in fiscal year 1998-1999.
  1 35    d.  Notwithstanding the fact that funds appropriated
  2  1 pursuant to this subsection will not be made available prior
  2  2 to July 1, 1996, the Iowa telecommunications and technology
  2  3 commission is authorized to negotiate and enter into contracts
  2  4 for ordering necessary equipment related to the completion of
  2  5 the connections authorized in paragraph "a" as deemed
  2  6 appropriate by the commission upon the effective date of this
  2  7 paragraph.
  2  8    2.  SUPPORT SERVICES.  There is appropriated from the
  2  9 general fund of the state to the Iowa communications network
  2 10 fund created in section 8D.14 for the fiscal year beginning
  2 11 July 1, 1996, and ending June 30, 1997, the following amount,
  2 12 or so much thereof as is necessary, to be used for the
  2 13 purposes designated:
  2 14    For purposes designated in paragraphs "a" and "b", and for
  2 15 not more than the following full-time equivalent positions:  
  2 16 .................................................. $  2,669,537
  2 17 ................................................FTEs       12.0
  2 18    a.  As a condition of the appropriation in this subsection,
  2 19 $808,037 of the amount appropriated shall be expended by the
  2 20 public broadcasting division of the department of education to
  2 21 provide support for functions related to the network,
  2 22 including but not limited to the following functions:
  2 23 scheduling for video classrooms; development of distance
  2 24 learning applications; development of a central information
  2 25 source on the Internet relating to educational uses of the
  2 26 network; a spare parts depot; second-line technical support
  2 27 for network sites; testing and initializing sites onto the
  2 28 network; and coordinating the work of the education
  2 29 telecommunications council.  The division is authorized an
  2 30 additional 7 FTEs for a total of 12 FTE positions for the
  2 31 purpose of providing such support.
  2 32    b.  As a further condition of the appropriation in this
  2 33 subsection, $1,861,500 of the amount appropriated shall be
  2 34 allocated by the public broadcasting division of the
  2 35 department of education to the regional telecommunications
  3  1 councils established in section 8D.5.  The regional
  3  2 telecommunications councils shall use the funds to provide
  3  3 technical assistance for network classrooms, planning and
  3  4 troubleshooting for local area networks, scheduling of video
  3  5 sites, and other related support activities.
  3  6    Sec. 2.  There is appropriated from the general fund of the
  3  7 state to the Iowa communications network fund created in
  3  8 section 8D.14 for the fiscal year beginning July 1, 1996, and
  3  9 ending June 30, 1997, the following amount, or so much thereof
  3 10 as is necessary, to lease DS-1 or T-1 circuits for Part III
  3 11 connections currently using analog technology:  
  3 12 ...................................................$     70,000
  3 13    Sec. 3.  There is appropriated from the rebuild Iowa
  3 14 infrastructure fund of the state created in section 8.57,
  3 15 subsection 5, to the department of public safety for the
  3 16 fiscal year beginning July 1, 1996, and ending June 30, 1997,
  3 17 the following amount, or so much thereof as is necessary, to
  3 18 be used for the purpose designated:
  3 19    For the purchase of terminal equipment and the payment of
  3 20 other costs associated with the upgrade of the existing Iowa
  3 21 online warrants and articles (IOWA) system to provide faster
  3 22 data transmission capabilities to existing subscribers, and in
  3 23 cooperation with the department of public defense to establish
  3 24 comparable data transmission service to the emergency
  3 25 management office in each county of the state:  
  3 26 .................................................. $    300,000
  3 27    Sec. 4.  Section 8D.13, Code Supplement 1995, is amended by
  3 28 adding the following new subsection:
  3 29    NEW SUBSECTION.  17A.  Access to the network shall be
  3 30 offered to the department of public safety and the department
  3 31 of public defense for the purpose of establishing and
  3 32 operating a shared data network providing law enforcement,
  3 33 emergency management, disaster service, emergency warning, and
  3 34 other emergency information dissemination services to federal,
  3 35 state, and local law enforcement agencies as provided in
  4  1 section 80.9, and local emergency management offices
  4  2 established under the authority of sections 29C.9 and 29C.10.
  4  3    Sec. 5.  ADDITIONAL CONNECTIONS.
  4  4    1.  LEWIS CENTRAL HIGH SCHOOL.  Notwithstanding section
  4  5 8D.13, subsection 5, the state may own and the Iowa
  4  6 telecommunications and technology commission shall provide for
  4  7 the construction and connection to the Iowa communications
  4  8 network of the Lewis Central high school, located in Council
  4  9 Bluffs and contiguous to the school for the deaf established
  4 10 under chapter 270.
  4 11    2.  ADDITIONS TO PART III.  The Iowa telecommunications and
  4 12 technology commission is authorized to contract for
  4 13 construction relating to connections to the Iowa
  4 14 communications network for authorized users not identified in
  4 15 the original Part III request for proposals, but which meet
  4 16 the definition of a Part III user pursuant to section 8D.13,
  4 17 subsection 2, paragraph "c".
  4 18    Sec. 6.  EFFECTIVE DATE.
  4 19    1.  Section 1, subsection 1, paragraph "d", of this Act,
  4 20 which authorizes the Iowa telecommunications and technology
  4 21 commission to begin negotiations for ordering necessary
  4 22 equipment prior to the availability of funding, being deemed
  4 23 of immediate importance, takes effect upon enactment.
  4 24    2.  Section 4 of this Act, which authorizes access to the
  4 25 network to be offered to certain law enforcement and emergency
  4 26 management agencies, being deemed of immediate importance,
  4 27 takes effect upon enactment.
  4 28    3.  Section 5, subsection 1, of this Act, which authorizes
  4 29 the state to construct and own the Iowa communications network
  4 30 connection to Lewis Central high school, being deemed of
  4 31 immediate importance, takes effect upon enactment.  
  4 32                           EXPLANATION
  4 33    This bill relates to the Iowa communications network by
  4 34 appropriating moneys for various network purposes and
  4 35 providing for the connection of additional Part III sites.
  5  1    The bill appropriates for the 1996-1997 fiscal year
  5  2 $2,669,537 from the general fund for educational support
  5  3 services and the support of 12 FTEs in the public broadcasting
  5  4 division of the department of education; $70,000 from the
  5  5 general fund to lease DS-1 or T-1 circuits for Part III
  5  6 connections currently using analog technology; $300,000 from
  5  7 the rebuild Iowa infrastructure account of the state to
  5  8 purchase terminal equipment and to pay other costs associated
  5  9 with the upgrade of the existing Iowa online warrants and
  5 10 articles (IOWA) system to provide faster data transmission
  5 11 capabilities to existing subscribers, and in cooperation with
  5 12 the department of public defense to establish comparable data
  5 13 transmission service to the emergency management office in
  5 14 each county of the state; $20,800,000 from the rebuild Iowa
  5 15 infrastructure account of the state for the connection of a
  5 16 minimum of 110 Part III authorized users.
  5 17    The bill amends section 8D.13 to provide that access be
  5 18 offered to the department of public safety and the department
  5 19 of public defense for the purpose of establishing and
  5 20 operating a shared data network providing law enforcement,
  5 21 emergency management, disaster service, emergency warning, and
  5 22 other emergency information dissemination services to federal,
  5 23 state, and local law enforcement agencies.
  5 24    The bill also authorizes the state to own a connection to
  5 25 the network for the Lewis Central high school in Council
  5 26 Bluffs, and authorizes the commission to contract for
  5 27 construction relating to connections to the network for
  5 28 authorized users not identified in the original Part III
  5 29 request for proposals, but which meet the definition of a Part
  5 30 III user pursuant to chapter 8D.
  5 31    The bill provides for the immediate effect of section 1,
  5 32 subsection 1, paragraph "d", which authorizes the Iowa
  5 33 telecommunications and technology commission to begin
  5 34 negotiations for ordering the necessary equipment associated
  5 35 with the Part III connections funded in this bill prior to the
  6  1 availability of the funding for such connections, for the
  6  2 immediate effect of section 4 which authorizes access to the
  6  3 network to certain law enforcement and emergency management
  6  4 agencies, and for the immediate effect of section 5,
  6  5 subsection 1, which authorizes the state to construct and own
  6  6 the network connection to Lewis Central high school.
