1 1 Section 1. Section 256.7, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 21. Determine, in collaboration with the
1 4 departments of public health and human services, an adequate
1 5 ratio of school nurses to school students to meet the health
1 6 needs of children from ages zero to twenty-one years in order
1 7 to permit students with serious, acute, or chronic health
1 8 problems to remain in the least restrictive environment and to
1 9 address regular and special education students' health needs
1 10 within the school setting. The board shall adopt rules
1 11 establishing guidelines for the employment of school nurses in
1 12 the ratio determined and requiring the board of directors of a
1 13 school district and the authorities in charge a nonpublic
1 14 school to employ school nurses according to the established
1 15 guidelines.
1 16 Sec. 2. STATE MANDATE NULLIFICATION. The state shall not
1 17 pay any additional costs incurred by a political subdivision
1 18 as a result of this Act.
1 19 EXPLANATION
1 20 This bill directs the state board of education to
1 21 determine, in collaboration with the departments of public
1 22 health and human services, an adequate ratio of school nurses
1 23 to school students to meet the health needs of children from
1 24 ages zero to 21 in order to permit students with serious,
1 25 acute, or chronic health problems to remain in the least
1 26 restrictive environment and to address regular and special
1 27 education students' health needs within the school setting.
1 28 The board shall adopt rules establishing guidelines for the
1 29 employment of school nurses in the ratio determined and
1 30 requiring the board of directors of a school district and the
1 31 authorities in charge a nonpublic school to employ school
1 32 nurses according to the established guidelines.
1 33 The bill may establish a state mandate under section 25B.3,
1 34 subsection 2. However, the bill provides that the state shall
1 35 not pay any additional cost incurred by a district or school
2 1 as a result of the bill's enactment.
