1 1 Section 1. Section 232.8, subsection 1, paragraph c, Code
1 2 Supplement 1995, is amended to read as follows:
1 3 c. Violations by a child, age sixteen or older, which
1 4 subject the child to the provisions of section 124.401,
1 5 subsection 1, paragraph "e" or "f", or violations of section
1 6 723A.2 which involve a violation of chapter 724, or violation
1 7 of chapter 724 which constitutes a felony, or violations which
1 8 constitute a forcible felony, and any other offenses committed
1 9 during the incident in which the excluded offense was
1 10 committed, are excluded from the jurisdiction of the juvenile
1 11 court and shall be prosecuted as otherwise provided by law
1 12 unless the court transfers jurisdiction of the child to the
1 13 juvenile court upon motion and for good cause. A child over
1 14 whom jurisdiction has not been transferred to the juvenile
1 15 court, and who is convicted of a violation excluded from the
1 16 jurisdiction of the juvenile court under this paragraph, shall
1 17 be sentenced pursuant to section 124.401B, 902.9, or 903.1.
1 18 Sec. 2. Section 232.52, subsection 2, paragraph e,
1 19 subparagraph (4), Code Supplement 1995, is amended to read as
1 20 follows:
1 21 (4) The child has previously been placed in a day
1 22 treatment program or in a treatment facility outside the
1 23 child's home.
1 24 Sec. 3. The legislative council is requested to establish
1 25 a study committee to review the need for more beds at the
1 26 state training school or for creating regional training school
1 27 facilities.
1 28 EXPLANATION
1 29 This bill provides that any offense committed by a juvenile
1 30 during the same incident in which a serious offense excluded
1 31 from the jurisdiction of the juvenile court was committed
1 32 shall also be excluded from the jurisdiction of the juvenile
1 33 court. Serious offenses excluded from the juvenile court's
1 34 jurisdiction are forcible felonies, certain controlled
1 35 substance offenses involving firearms, criminal gang offenses
2 1 involving weapons, and felony violations of chapter 724
2 2 involving weapons.
2 3 The bill also provides that the criteria for placing a
2 4 juvenile in the state training school include a previous
2 5 commitment to a day treatment program.
2 6 In addition, the bill requests the legislative council to
2 7 create a study committee to review the need for additional
2 8 beds at the state training school or for creating regional
2 9 training schools.
