1 1 Section 1. Section 142C.11, Code Supplement 1995, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 5. a. A hospital, health care
1 4 professional licensed or certified pursuant to chapter 148,
1 5 148C, 150, 150A, or 152, medical examiner, technician, or
1 6 enucleator shall not prevent or impede the donation of a part
1 7 by an individual who has executed a document of gift or by a
1 8 person authorized to make an anatomical gift pursuant to this
1 9 chapter.
1 10 b. A health care professional licensed or certified
1 11 pursuant to chapter 148, 148C, 150, 150A, or 152, medical
1 12 examiner, technician, or enucleator who willfully and wantonly
1 13 prevents or impedes the donation of a part in violation of
1 14 paragraph "a" is subject to sanctions imposed by the person's
1 15 respective examining board designated pursuant to section
1 16 147.13.
1 17 c. This subsection shall not be interpreted to preclude a
1 18 medical examiner from preventing or impeding the donation of a
1 19 part if the donation would substantially affect a criminal
1 20 investigation.
1 21 EXPLANATION
1 22 This bill prohibits certain professionals from preventing
1 23 or impeding the making of an anatomical gift which is donated
1 24 through execution of a document of gift or by a person
1 25 authorized to make a gift under the uniform anatomical gift
1 26 Act. A professional who willfully and wantonly prevents or
1 27 impedes such a donation is subject to sanctioning by the
1 28 respective examining board. The bill provides that the
1 29 prohibition is not to be interpreted to prevent a medical
1 30 examiner from preventing or impeding the making of an
1 31 anatomical gift if the donation would substantially affect a
1 32 criminal investigation.
