PAG LIN 1 1 Section 1. Section 8.62, Code 1995, is amended to read as 1 2 follows: 1 3 8.62 USE OF REVERSIONS. 1 4 For the purposes of this section, "operational 1 5 appropriation" means an appropriation from the general fund of 1 6 the state providing for salary, support, administrative 1 7 expenses, or other personnel-related costs. Notwithstanding 1 8 the provisions of section 8.33 or any other provision of law 1 9 to the contrary, if on June 30 ofthea fiscalyears ending in1 101995 and 1996year, a balance of an operational appropriation 1 11 for that year remains unexpended or unencumbered, not more 1 12 than fifty percent of the balance may be encumbered by the 1 13 agency to which the appropriation was made and used as 1 14 provided in this section and the remaining balance shall be 1 15 deposited in the cash reserve fund created in section 8.56. 1 16 Moneys encumbered under this section shall only be used by the 1 17 agency during the succeeding fiscal year for employee training 1 18 and for technology enhancement. Unused moneys encumbered 1 19 under this section shall be deposited in the cash reserve fund 1 20 on June 30 of the succeeding fiscal year. On or before June 1 21 30 of each fiscal year,1996 and 1997,an agency encumbering 1 22 funds under this section shall report to the joint 1 23 appropriations subcommittee which recommends funding for the 1 24 agency, the legislative fiscal bureau, the department of 1 25 management, and the legislative fiscal committee of the 1 26 legislative council detailing how the moneys encumbered in the 1 27 previous fiscal year were expended.MoneysExcept for an 1 28 intradepartmental transfer from an operational appropriation, 1 29 moneys shall not be encumbered under this section from an 1 30 appropriation which received a transfer from another 1 31 appropriation pursuant to section 8.39.This section is1 32repealed on September 1, 1997.1 33 EXPLANATION 1 34 This bill authorizes state agencies to encumber in future 1 35 fiscal years a portion of an operational appropriation for 2 1 certain purposes. 2 2 Section 8.62 currently authorizes for fiscal years 1994- 2 3 1995 and 1995-1996, a state agency to encumber up to 50 2 4 percent of an operational appropriation which remains 2 5 unexpended or unencumbered on June 30, the closing date of the 2 6 fiscal year. The encumbered moneys can be used by the agency 2 7 during the succeeding fiscal year for employee training and 2 8 technological enhancement. 2 9 Current law prohibits the encumbrance of an operational 2 10 appropriation which received a transfer of moneys from another 2 11 appropriation. The bill authorizes such encumbrance if the 2 12 transfer was intradepartmental from another operational 2 13 appropriation. 2 14 The bill deletes provisions in the section providing for 2 15 repeal of the section on September 1, 1997. 2 16 LSB 3601XL 76 2 17 jp/jj/8.1
