  1  1    Section 1.  NEW SECTION.  142C.9A  DOCUMENTATION OF
  1  2 REQUESTS FOR ANATOMICAL GIFTS.
  1  3    1.  Beginning January 1, 1997, a hospital shall document
  1  4 compliance with federal regulations and state rules relating
  1  5 to referral of potential donors to an organ procurement
  1  6 organization, by completing a certificate of request form for
  1  7 each death occurring in the hospital.  The Iowa department of
  1  8 public health shall develop the certificate of request forms
  1  9 and shall make the forms available to hospitals upon request.
  1 10 A hospital may use a form developed by the hospital in lieu of
  1 11 the departmental form.  Forms developed shall provide for
  1 12 inclusion of all of the following information:
  1 13    a.  The name of the hospital.
  1 14    b.  The hospital patient identification number.
  1 15    c.  The date of death of the decedent.
  1 16    d.  The age and sex of the decedent.
  1 17    e.  The cause of death of the decedent.
  1 18    f.  Whether a person authorized to make an anatomical gift
  1 19 pursuant to section 142C.4 was contacted to obtain consent for
  1 20 an anatomical gift and whether consent was obtained.
  1 21    g.  The name of the person making the request.
  1 22    h.  Whether a referral was made by the hospital to an organ
  1 23 procurement organization or bank or storage organization.
  1 24    i.  The name of the person completing the certificate of
  1 25 request form.
  1 26    j.  The signature of the person completing the certificate
  1 27 of request form.
  1 28    2.  The hospital administrator shall retain a completed
  1 29 certificate of request form in a centralized location for a
  1 30 minimum of seven years following the date of a patient's
  1 31 death.
  1 32    Sec. 2.  NEW SECTION.  142A.9B  ANNUAL REPORTS &endash; IOWA
  1 33 DEPARTMENT OF PUBLIC HEALTH.
  1 34    1.  Beginning in 1998, a hospital shall submit an annual
  1 35 report to the Iowa department of public health on or before
  2  1 March 1 which includes all of the following:
  2  2    a.  The number of deaths occurring in the hospital in the
  2  3 previous calendar year.
  2  4    b.  A copy of each certificate of request form completed in
  2  5 the previous calendar year.
  2  6    2.  Notwithstanding the requirement for annual submission
  2  7 of reports pursuant to subsection 1, a hospital which
  2  8 demonstrates that a certificate of request was completed for
  2  9 at least seventy percent of all deaths occurring at the
  2 10 hospital in the previous calendar year is exempt from
  2 11 submitting subsequent annual reports for the four-year period
  2 12 following submission of the report which demonstrates
  2 13 compliance.
  2 14    3.  The Iowa department of public health may inspect or may
  2 15 request copies of certificate of request forms from a hospital
  2 16 for any calendar year.
  2 17    4.  The Iowa department of public health shall provide an
  2 18 organ procurement organization with a copy of the annual
  2 19 report of any hospital upon request.
  2 20    5.  Any patient information provided to the Iowa department
  2 21 of public health or to an organ procurement organization under
  2 22 this section shall remain confidential.
  2 23    Sec. 3.  NEW SECTION.  142C.9C  REPORTING REQUIREMENTS AND
  2 24 DUTIES OF ORGAN PROCUREMENT ORGANIZATIONS AND BANKS OR STORAGE
  2 25 ORGANIZATIONS.
  2 26    Beginning January 1, 1997, an organ procurement
  2 27 organization and a bank or storage organization shall submit
  2 28 an annual report to the Iowa department of public health which
  2 29 shall include all of the following, as applicable:
  2 30    1.  The name of the organ procurement organization or bank
  2 31 or storage organization submitting the report.
  2 32    2.  The total number of potential donor referrals received
  2 33 by the organ procurement organization or bank or storage
  2 34 organization and the names of the hospitals providing the
  2 35 referrals.
  3  1    3.  The total number of actual anatomical gifts realized
  3  2 and the names of the hospitals from which the anatomical gifts
  3  3 originated.
  3  4    4.  In the case of an organ procurement organization, the
  3  5 number of cases under subsections 2 and 3 which were referred
  3  6 by a bank or storage organization.  
  3  7                           EXPLANATION
  3  8    This bill establishes documentation and reporting
  3  9 requirements for hospitals, organ procurement organizations,
  3 10 and banks or storage organizations relating to anatomical
  3 11 gifts.  The bill requires that beginning January 1, 1997, each
  3 12 hospital is to document compliance with federal and state
  3 13 requirements relating to anatomical gifts by completing a
  3 14 certificate of request form for each death occurring in that
  3 15 hospital.  The bill specifies the information to be included
  3 16 in the form, which is to be developed by and is to be made
  3 17 available through the Iowa department of public health, or
  3 18 which is to be provided by the hospital itself if the form
  3 19 includes all of the specified information.  Each hospital
  3 20 administrator is to retain the completed certificates for a
  3 21 minimum period of seven years following the date of the
  3 22 patient's death.
  3 23    The bill also requires that beginning January 1, 1998, each
  3 24 hospital submit an annual report to the Iowa department of
  3 25 public health on or before March 1 which includes the number
  3 26 of deaths at the hospital and copies of all certificates of
  3 27 request completed during the previous calendar year.  If a
  3 28 hospital demonstrates that certificates of request have been
  3 29 completed for at least 70 percent of the deaths in the
  3 30 hospital in the previous year, the hospital is exempt from
  3 31 submitting an annual report for the following four years.  The
  3 32 Iowa department of public health is authorized to inspect or
  3 33 request certificates of request for any hospital for any
  3 34 calendar year and is directed to provide an organ procurement
  3 35 organization with copies of the annual reports, upon the
  4  1 request of the organization.  The bill provides that patient
  4  2 information provided to the department or to an organ
  4  3 procurement organization is to remain confidential.
  4  4    The bill also requires that beginning January 1, 1997, all
  4  5 organ procurement organizations and banks or storage
  4  6 organizations are to submit annual reports to the Iowa
  4  7 department of public health which include the name of the
  4  8 organ procurement organization and bank or storage
  4  9 organization submitting the reports, the total number of
  4 10 potential donor referrals received and the name of each
  4 11 hospital making a referral, the total number of actual
  4 12 anatomical gifts realized and the name of each hospital from
  4 13 which the gift originated.  For organ procurement
  4 14 organizations, the reports are also to identify the cases of
  4 15 potential donors and of anatomical gifts realized which were
  4 16 referred by a bank or storage organization.
