1 1 Section 1. Section 331.401, subsection 3, Code 1995, is
1 2 amended to read as follows:
1 3 3. a. The board shall not pay bounties on crows,
1 4 rattlesnakes, foxes, or wolves other than coyotes.
1 5 b. A county may receive reimbursement from the department
1 6 of natural resources for bounty payments on coyotes, as
1 7 provided in section 455A.10. In order to receive
1 8 reimbursement, the county must submit the total number of
1 9 bounty claims subject to reimbursement as provided by rules
1 10 adopted by the department. The county must maintain a list of
1 11 persons holding an interest in land located within the county
1 12 who authorize the destruction of coyotes on their land. A
1 13 reimbursable claim is made when a coyote is destroyed on land
1 14 listed with the county as certified by the person destroying
1 15 the coyote and a person holding an interest in the land. A
1 16 person who fraudulently submits a claim or certifies that a
1 17 coyote has been destroyed on listed land is guilty of a simple
1 18 misdemeanor.
1 19 Sec. 2. Section 455A.10, Code 1995, is amended by adding
1 20 the following new unnumbered paragraph:
1 21 NEW UNNUMBERED PARAGRAPH. Of the moneys remaining in the
1 22 state fish and game protection fund which are not specifically
1 23 appropriated by the general assembly during any fiscal year,
1 24 twenty-five thousand dollars is appropriated and shall be used
1 25 by the department to reimburse counties for the payment of
1 26 claims for bounties paid on coyotes as provided in section
1 27 331.401. If the total amount of eligible claims exceeds
1 28 twenty-five thousand dollars, the department shall prorate the
1 29 reimbursement amount to provide an equal payment for all
1 30 claims.
1 31 EXPLANATION
1 32 This bill provides that a county may receive reimbursement
1 33 from the department of natural resources for bounty payments
1 34 on coyotes. The bill provides that in order to receive
1 35 reimbursement, the county must submit the total number of
2 1 bounty claims subject to reimbursement to the department. The
2 2 bill requires a county to maintain a list of landowners in the
2 3 county who authorize the destruction of coyotes on their land.
2 4 The bill provides that a reimbursable claim is made when a
2 5 coyote is destroyed on land listed with the county. The bill
2 6 appropriates $25,000 from the state fish and game protection
2 7 fund during each fiscal year to reimburse counties for the
2 8 payment of claims for bounties paid on coyotes. The bill
2 9 provides that if the total amount of eligible claims exceeds
2 10 $25,000, the department shall prorate the reimbursement
2 11 amount. The bill provides that a person who fraudulently
2 12 submits a claim or fraudulently certifies that a coyote has
2 13 been destroyed on listed land shall be guilty of a simple
2 14 misdemeanor.
