1 1 Section 1. NEW SECTION. 295.1 LEGISLATIVE FINDINGS AND
1 2 INTENT.
1 3 The general assembly finds that it is in the public
1 4 interest to develop and equitably fund instructional
1 5 technology within the public schools of this state to ensure
1 6 that school students, teachers, and administrators are
1 7 equipped and prepared to excel in the twenty-first century.
1 8 Toward that goal, it is the intent of this Act to establish
1 9 and fund a school improvement technology program as provided
1 10 in this chapter.
1 11 Sec. 2. NEW SECTION. 295.2 SCHOOL IMPROVEMENT TECHNOLOGY
1 12 APPROPRIATION.
1 13 1. There is appropriated from the general fund of the
1 14 state to the department of education for each fiscal year of
1 15 the fiscal period beginning July 1, 1996, and ending June 30,
1 16 2000, the sum of thirty million dollars for the school
1 17 improvement technology program.
1 18 2. From the moneys appropriated in subsection 1 other than
1 19 the moneys allocated in subsection 3, for each fiscal year of
1 20 the fiscal period beginning July 1, 1996, and ending June 30,
1 21 2001, the amount of moneys allocated to school districts shall
1 22 be in the proportion that the basic enrollment of a district,
1 23 bears to the sum of the basic enrollment of all school
1 24 districts in the state for the budget year. However, a
1 25 district shall not receive less than fifteen thousand dollars
1 26 in a fiscal year. The Iowa braille and sight saving school,
1 27 the state school for the deaf, and the Price laboratory school
1 28 at the university of northern Iowa shall annually certify
1 29 their basic enrollment to the department of education by
1 30 October 1.
1 31 3. From the moneys appropriated in subsection 1, each area
1 32 education agency shall be allocated thirty thousand dollars.
1 33 In addition, the sum of four hundred fifty thousand dollars
1 34 shall be divided among the area education agencies based upon
1 35 each area education agency's percentage of the total full-time
2 1 equivalent elementary and secondary teachers employed in the
2 2 school districts in this state.
2 3 4. For each year in which an appropriation is made to the
2 4 school improvement technology program, the department of
2 5 education shall notify the department of revenue and finance
2 6 of the amount to be paid to each school district and area
2 7 education agency based upon the distribution plan set forth
2 8 for the appropriation made pursuant to this section. The
2 9 allocation to each school district and area education agency
2 10 under this section shall be made in one payment on or about
2 11 October 15 of the fiscal year in which the appropriation is
2 12 made, taking into consideration the relative budget and cash
2 13 position of the state resources. Prior to the receipt of
2 14 funds, school districts shall provide to the department of
2 15 education adequate assurance that they have developed or are
2 16 developing a technology plan as required by section 295.3 and
2 17 that funds received under this section will be used in
2 18 accordance with the required technology plan.
2 19 5. Moneys received under this section shall not be
2 20 commingled with state aid payments made under sections 257.16
2 21 and 257.35 to a school district or area education agency and
2 22 shall be accounted for by the local school district or area
2 23 education agency separately from state aid payments.
2 24 6. Payments made to school districts and area education
2 25 agencies under this section are miscellaneous income for
2 26 purposes of chapter 257. Each local school district and area
2 27 education agency shall maintain a separate listing within
2 28 their budgets for payments received and expenditures made
2 29 pursuant to this section.
2 30 7. For purposes of this section, "school district" means a
2 31 school district, the Iowa braille and sight saving school, the
2 32 state school for the deaf, and the Price laboratory school at
2 33 the university of northern Iowa.
2 34 Sec. 3. NEW SECTION. 295.3 SCHOOL IMPROVEMENT TECHNOLOGY
2 35 PLANNING.
3 1 1. The board of directors of a school district shall
3 2 develop a technology plan that supports school improvement
3 3 technology efforts and includes an evaluation component. The
3 4 plan shall focus on the attainment of student achievement
3 5 goals under sections 280.12 and 280.18 and shall demonstrate
3 6 how, over a four-year period, the board will utilize
3 7 technology to improve student achievement. Technology plans
3 8 shall be kept on file in the district and a copy sent to the
3 9 appropriate area education agency. Progress made under these
3 10 plans shall be included as part of the annual report submitted
3 11 to the department of education in compliance with sections
3 12 280.12 and 280.18.
3 13 2. Each area education agency shall develop a plan to
3 14 assist school districts in the development of a technology
3 15 planning process to meet the purposes of this chapter. The
3 16 plan shall describe how the area education agency intends to
3 17 support school districts with instructional technology staff
3 18 development and training. For the fiscal year beginning July
3 19 1, 1996, and ending June 30, 1997, prior to the receipt of
3 20 funds, each area education agency shall provide the department
3 21 of education adequate assurance that a technology plan as
3 22 required under this section has been or is being developed.
3 23 For the fiscal year beginning July 1, 1997, and for each
3 24 succeeding fiscal year, each area education agency shall
3 25 submit its plan to the department of education. The
3 26 department shall approve each plan prior to the disbursement
3 27 of funds. The department of education, in collaboration with
3 28 the area education agencies, shall develop specification
3 29 requirements for staff development and training and technology
3 30 planning assistance to be provided by the area education
3 31 agencies pursuant to this section.
3 32 3. The Iowa braille and sight saving school, the state
3 33 school for the deaf, and the Price laboratory school at the
3 34 university of northern Iowa shall develop a technology plan
3 35 that supports and improves student achievement, demonstrates
4 1 how technology will be utilized to improve student
4 2 achievement, and includes an evaluation component. Plans and
4 3 an annual progress report shall be submitted to the state
4 4 board of regents and the department of education.
4 5 Sec. 4. NEW SECTION. 295.4 SCHOOL IMPROVEMENT AND
4 6 TECHNOLOGY EXPENDITURES.
4 7 1. School districts, as defined in section 295.2,
4 8 subsection 7, shall expend funds received pursuant to section
4 9 295.2 for the acquisition, installation, and maintenance of
4 10 instructional technology equipment, including hardware and
4 11 software, materials and supplies related to instructional
4 12 technology and staff development and training, and shall
4 13 establish priorities for the use of the funds.
4 14 2. Funds received by an area education agency pursuant to
4 15 section 295.2 shall be expended for the costs related to
4 16 supporting school districts within the area served with
4 17 technology planning and equipment, including hardware and
4 18 software, materials and supplies related to instructional
4 19 technology and staff development and training.
4 20 Sec. 5. NEW SECTION. 295.5 REPEAL.
4 21 This chapter is repealed effective July 1, 2001.
4 22 EXPLANATION
4 23 This bill establishes a school improvement technology
4 24 program and appropriates $150 million over a five-year period.
4 25 The funds, $30 million for each fiscal year of the fiscal
4 26 period beginning July 1, 1996, and ending June 30, 2001, are
4 27 appropriated to the department of education for allocation to
4 28 school districts, the Iowa braille and sight saving school,
4 29 the state school for the deaf, and the Price laboratory school
4 30 at the university of northern Iowa and area education
4 31 agencies. The funds are to be used by the districts, the Iowa
4 32 braille and sight saving school, the state school for the
4 33 deaf, and the Price laboratory school at the university of
4 34 northern Iowa and area education agencies to acquire, install,
4 35 and maintain instructional technology equipment, which the
5 1 bill defines as including hardware and software, materials and
5 2 related supplies, and staff development and training.
5 3 The board of directors of a school district, the Iowa
5 4 braille and sight saving school, the state school for the
5 5 deaf, and the Price laboratory school at the university of
5 6 northern Iowa are each required to develop a technology plan
5 7 that supports school improvement efforts, demonstrates how
5 8 technology will be used to improve student achievement, and
5 9 includes an evaluation component. Area education agencies are
5 10 required to support districts with technology planning. The
5 11 district is to keep a copy on file and send a copy to its area
5 12 education agency. The Iowa braille and sight saving school,
5 13 the state school for the deaf, and the Price laboratory school
5 14 at the university of northern Iowa are to submit plans and a
5 15 progress report to the state board of regents and the
5 16 department of education. With respect to school districts,
5 17 progress made under the plan shall be submitted to the
5 18 department of education as part of the report currently
5 19 required under sections 280.12 and 280.18.
5 20 Each area education agency is also required to develop a
5 21 plan to assist school districts in the development of their
5 22 plans and to describe how the area education agency will
5 23 support school districts with instructional technology staff
5 24 development and training. For the fiscal year beginning July
5 25 1, 1996, each area education agency shall provide to the
5 26 department adequate assurance that a plan is being developed
5 27 and for subsequent fiscal years, the department must annually
5 28 approve each area education agency plan prior to the
5 29 disbursement of funds.
5 30 The bill requires the department of education, in
5 31 collaboration with the area education agencies, to develop
5 32 specifications for staff development and training and
5 33 technology planning assistance.
5 34 Under the bill, the chapter establishing the school
5 35 improvement technology program is repealed effective July 1,
6 1 2001.
