  1  1    Section 1.  NEW SECTION.  295.1  INTENT.
  1  2    It is in the public interest to develop, fund, and
  1  3 encourage classrooms within the public school system of the
  1  4 state of Iowa to ensure that school children, teachers, and
  1  5 administrators are equipped and prepared to excel in the
  1  6 twenty-first century.
  1  7    Sec. 2.  NEW SECTION.  295.2  SCHOOL IMPROVEMENT AND
  1  8 TECHNOLOGY ASSISTANCE TRUST FUND.
  1  9    1.  A school improvement and technology assistance trust
  1 10 fund is created in the office of the treasurer of state under
  1 11 the control of the department of education.  There is
  1 12 appropriated to the technology assistance trust fund for the
  1 13 fiscal year beginning July 1, 1995, and ending June 30, 1996,
  1 14 the sum of fifteen million dollars from the general fund of
  1 15 the state.  There is appropriated to the technology assistance
  1 16 trust fund for the fiscal year beginning July 1, 1996, and
  1 17 ending June 30, 1997, the sum of fifteen million dollars from
  1 18 the general fund of the state.
  1 19    2.  The payment to a school district or area education
  1 20 agency for a fiscal year for a plan submitted under section
  1 21 295.3 shall be equivalent proportionately to the payments made
  1 22 to school districts or area education agencies for phase III
  1 23 pursuant to section 294A.14 for that year.
  1 24    3.  Any moneys received under this chapter, and any
  1 25 interest accrued on the moneys, shall not be commingled with
  1 26 state aid payments made, under sections 257.16 and 257.35, to
  1 27 a school district or area education agency and shall be
  1 28 accounted for by the school district and area education agency
  1 29 separately from state aid payments.
  1 30    4.  Payments made to school districts and area education
  1 31 agencies under this chapter are miscellaneous income for
  1 32 purposes of chapter 257.  Each district and area education
  1 33 agency shall maintain a separate listing within their budgets
  1 34 for payments received and expenditures made pursuant to this
  1 35 chapter.
  2  1    5.  Notwithstanding section 12C.7, interest or other income
  2  2 earned by the fund shall remain in the school improvement and
  2  3 technology assistance trust fund and used for the purposes of
  2  4 the fund.
  2  5    Sec. 3.  NEW SECTION.  295.3  SCHOOL IMPROVEMENT AND
  2  6 TECHNOLOGY COMMITTEES &endash; PLAN.
  2  7    The board of directors of a school district and the board
  2  8 of directors of an area education agency shall each establish
  2  9 a school improvement and technology committee to develop a
  2 10 school improvement and technology plan that includes an
  2 11 evaluation component.  The evaluation component shall be
  2 12 designed to measure the district's and the agency's progress
  2 13 toward meeting its school improvement and technology goals.
  2 14 The plan shall support and focus on the improvement of student
  2 15 achievement and the attainment of student achievement goals
  2 16 under sections 280.12 and 280.18.  Each committee shall be
  2 17 made up of an equal number of administrators and instructional
  2 18 or support staff.  If the school district or area education
  2 19 agency is organized for collective bargaining purposes, the
  2 20 certified bargaining representative for the licensed employees
  2 21 shall appoint the members of the committee which represent the
  2 22 instructional or support staff.
  2 23    Sec. 4.  NEW SECTION.  295.4  SCHOOL IMPROVEMENT AND
  2 24 TECHNOLOGY EXPENDITURES.
  2 25    1.  Funds received under this chapter by a school district
  2 26 or area education agency shall be expended for one or more of
  2 27 the following purposes:
  2 28    a.  To provide additional time for activities and
  2 29 responsibilities that are part of the school improvement and
  2 30 technology plan approved by a school district or an area
  2 31 education agency and are in addition to the regular activities
  2 32 and duties of the school district and its instructional staff
  2 33 or of the agency and its school service personnel.
  2 34    b.  To provide for the costs of substitute instructional
  2 35 staff to permit the regular instructional staff to engage in
  3  1 planning or staff development activities that are part of the
  3  2 school improvement and technology plan.
  3  3    c.  To provide for the costs associated with specialized or
  3  4 general staff development that are part of the school
  3  5 improvement and technology plan.
  3  6    d.  To purchase or lease telephone equipment, computers,
  3  7 computer networks, computer programs, computer software,
  3  8 computer systems, and for computer services as defined in
  3  9 section 716A.1.
  3 10    e.  For maintaining purchases listed under this section.
  3 11    f.  The costs of establishing an electronic classroom, or
  3 12 purchasing or leasing satellite equipment, receiving
  3 13 equipment, studio and production equipment, and other
  3 14 associated equipment.
  3 15    g.  The costs of purchasing or leasing audio, video, or
  3 16 audiovisual machines, machinery, or equipment.
  3 17    2.  Not less than ten percent of the moneys received under
  3 18 this chapter shall be used by a district or agency for
  3 19 training or staff development in the use of equipment or
  3 20 software purchased or leased under this section.
  3 21    3.  The education telecommunications council, created in
  3 22 section 8D.5, shall recommend appropriate standards for the
  3 23 educational technology to be purchased or leased under this
  3 24 section.  These technology standards shall ensure that
  3 25 technology and infrastructure procured by school districts and
  3 26 area education agencies are compatible, uniform, and
  3 27 interconnective.  
  3 28                           EXPLANATION
  3 29    This bill directs each school district and area education
  3 30 agency to establish a school improvement and technology plan
  3 31 to be submitted annually to the department of education for
  3 32 audit and examination.  The bill creates a school improvement
  3 33 and technology assistance trust fund and provides for a two-
  3 34 year appropriation to the trust fund to fund school
  3 35 improvement activities, staffing, and technology relating to
  4  1 implementation of the school improvement and technology plans.
  4  2    The intent of the general assembly, as provided in the
  4  3 bill, is to provide additional resources for improvement at
  4  4 the school level, which includes providing compensation for
  4  5 school district instructional staff and area education agency
  4  6 support staff for school improvement efforts, and access by
  4  7 Iowa's school districts and area education agencies to
  4  8 computers, computer technology, and technology consultation
  4  9 and staff development.
  4 10    The board of directors of a school district and the board
  4 11 of directors of an area education agency shall each establish
  4 12 a school improvement and technology committee, consisting of
  4 13 equal numbers of administrators and instructional or support
  4 14 staff, to develop a school improvement and technology plan
  4 15 that supports and focuses on the improvement of student
  4 16 achievement and the attainment of student achievement goals
  4 17 under sections 280.12 and 280.18.
  4 18    Funds received by a school district or area education
  4 19 agency under the bill shall be expended for one or more of the
  4 20 following purposes approved under a school improvement and
  4 21 technology plan:  for activities and responsibilities that are
  4 22 in addition to regular activities and duties; to provide for
  4 23 the costs of substitute instructional staff to permit regular
  4 24 instructional staff to engage in planning or training
  4 25 activities; to provide for specialized or general training
  4 26 costs; for staff development activities; to purchase or lease
  4 27 telephone equipment, computers, computer networks, computer
  4 28 programs, computer software, computer systems, and for
  4 29 computer services as defined in section 716A.1; for
  4 30 maintaining purchases listed in the bill; for establishing an
  4 31 electronic classroom, or purchasing or leasing satellite
  4 32 equipment, receiving equipment, studio and production
  4 33 equipment, and other associated equipment; for purchasing or
  4 34 leasing audio, visual, or audiovisual machines, machinery, or
  4 35 equipment; and for training or staff development in the use of
  5  1 equipment or software purchased or leased.
  5  2    The education telecommunications council is directed to
  5  3 develop standards for the technology purchased pursuant to the
  5  4 bill to ensure compatibility and uniformity.  A district or
  5  5 area education agency that receives school improvement and
  5  6 technology moneys must complete and submit to the department
  5  7 an assessment instrument.
  5  8    The bill provides appropriations of $15 million for FY
  5  9 1995-1996, and for FY 1996-1997, from the general fund of the
  5 10 state to the department of education to be used for the school
  5 11 improvement and technology program.  Payment to a school
  5 12 district or area education agency for a fiscal year for a plan
  5 13 annually submitted to the department shall be equivalent
  5 14 proportionately to the amount of the payment made to that
  5 15 school district or area education agency for phase III
  5 16 pursuant to section 294A.14 for that year.
