Senate Study Bill 324

  1  1    Section 1.  Section 461A.25, Code 1995, is amended to read
  1  2 as follows:
  1  3    461A.25  LEASES AND EASEMENTS.
  1  4    1.  The commission may recommend that the executive council
  1  5 lease shall adopt rules providing for the leasing of property
  1  6 under the commission's jurisdiction.  All leases shall reserve
  1  7 to the public of the state the right to enter upon the
  1  8 property leased for any lawful purpose.  The council may, if
  1  9 it approves the recommendation and If the lease to be entered
  1 10 into is for five years or less, the director may execute the
  1 11 lease in behalf of the state and commission.  If the
  1 12 recommendation is for a lease is in excess of five years, with
  1 13 the exception of agricultural lands specifically dealt with in
  1 14 Article I, section 24 of the Constitution of the State of
  1 15 Iowa, the council director shall advertise for bids.  If a bid
  1 16 is accepted, the lease shall be let or executed by the council
  1 17 director in accordance with the most desirable bid.  The lease
  1 18 shall not be executed for a term longer than fifty years.  Any
  1 19 such A leasehold interest, including any improvements placed
  1 20 on it, shall be listed on the tax rolls as provided in
  1 21 chapters 428 and 443; assessed and valued as provided in
  1 22 chapter 441; taxes shall be levied on it as provided in
  1 23 chapter 444 and collected as provided in chapter 445; and the
  1 24 leasehold interest is subject to tax sale, redemption, and
  1 25 apportionment of taxes as provided in chapters 446, 447 and
  1 26 448.  The lessee shall discharge and pay all taxes.
  1 27    2.  The commission shall adopt rules providing for the
  1 28 granting of easements to political subdivisions and utility
  1 29 companies.  The applicant for an easement shall provide the
  1 30 director with information specifying the need for the
  1 31 easement, availability of alternatives, and measures proposed
  1 32 to prevent or minimize adverse impacts on the affected
  1 33 property.  The director shall execute the easement which shall
  1 34 be approved as to form by the attorney general and, if granted
  1 35 for a term longer than five years, shall be approved by the
  2  1 commission.  
  2  2                           EXPLANATION
  2  3    This bill provides for leases of state-owned property under
  2  4 the jurisdiction of the natural resources commission to be
  2  5 granted pursuant to rules adopted by the commission.  The bill
  2  6 removes the requirement that leases also be approved by the
  2  7 executive council.  The bill also specifies that the
  2  8 commission has authority to approve the granting of easements
  2  9 to political subdivisions and utility companies.
