PAG LIN 1 1 Section 1. Section 206.6, subsection 3, Code 1995, is 1 2 amended to read as follows: 1 3 3. EXAMINATION FOR COMMERCIAL APPLICATOR LICENSE. 1 4 a. Thesecretary of agriculturedepartment shall not issue 1 5 a commercial applicator license until the individual engaged 1 6 in or managingthea pesticide application business and 1 7 employed by the business to apply pesticides is certified by 1 8 passing an examination, as required pursuant to section 206.5, 1 9 to demonstrate to thesecretarydepartment that the 1 10individual's knowledge of howindividual is qualified to apply 1 11 pesticides underthe classificationseach classification for 1 12 which the individual has appliedfor, andthe individual's1 13knowledge ofis knowledgeable about the nature and effect of 1 14 pesticides that the individual may apply undersuch1 15classificationsthe classification. 1 16 b. The individual applying for a license under a 1 17 classification related to commercial turf grass care shall not 1 18 be issued a license, unless the individual provides evidence 1 19 according to procedures and in a manner required by the 1 20 department that the individual has done any of the following: 1 21 (1) Earned a degree relating to pesticide management from 1 22 an accredited educational institutional approved by the 1 23 department. 1 24 (2) Served as an apprentice to a commercial applicator 1 25 licensed pursuant to this chapter for at least one year. 1 26 (3) Been certified or licensed to apply pesticides in 1 27 another state, as provided by rules adopted by the department. 1 28 c. The applicant successfully completing the certification 1 29 requirement shall be a licensed commercial applicator. 1 30 EXPLANATION 1 31 This bill amends chapter 206, which in part regulates the 1 32 application of pesticides and the licensing and certification 1 33 of applicators, including commercial applicators. The 1 34 department is currently prohibited from issuing a license to a 1 35 commercial applicator, unless the individual is certified by 2 1 passing an examination to demonstrate the individual's 2 2 qualifications. This bill provides that an individual 2 3 applying for a license under a classification related to 2 4 commercial turf grass care is prohibited from receiving a 2 5 license, unless the individual provides evidence that the 2 6 individual has completed preliminary requirements. The 2 7 individual must have earned a degree relating to pesticide 2 8 management from an accredited educational institution approved 2 9 by the department, have served as an apprentice to a 2 10 commercial applicator licensed pursuant to this chapter for at 2 11 least one year, or have been certified or licensed to apply 2 12 pesticides in another state. 2 13 LSB 2579SC 76 2 14 da/jw/5
