  1  1    Section 1.  Section 614.8, Code 1995, is amended to read as
  1  2 follows:
  1  3    614.8  MINORS AND MENTALLY ILL PERSONS.
  1  4    The Except for actions for malpractice involving minors,
  1  5 the times limited for actions herein, except those brought for
  1  6 penalties and forfeitures, shall be extended in favor of
  1  7 minors and mentally ill persons, so that they shall have one
  1  8 year from and after the termination of such disability within
  1  9 which to commence said the action.  A claim for injuries to a
  1 10 minor due to malpractice shall be brought within the time
  1 11 limits set by section 614.1, subsection 9.  
  1 12                           EXPLANATION
  1 13    This bill provides that minors are subject to the same
  1 14 statute of limitations for medical malpractice as adults.
  1 15 Malpractice actions must be filed within two years of the
  1 16 occurrence of the injury, the discovery of the injury, or the
  1 17 point at which the injury should reasonably have been
  1 18 discovered, but not more than six years after the date of the
  1 19 injury serving as the basis for the action unless the injury
  1 20 involves a foreign object unintentionally left in the body.
