1 1 Section 1. Section 236.3B, Code 1995, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. The county attorney shall
1 4 utilize the funds remitted to the county treasurer in section
1 5 321.191, subsection 9, to defray the costs of the assistance
1 6 authorized in this section.
1 7 Sec. 2. Section 321.191, subsection 9, Code 1995, is
1 8 amended by adding the following new unnumbered paragraph:
1 9 NEW UNNUMBERED PARAGRAPH. If a fee is imposed by this
1 10 subsection, an additional one hundred dollar administrative
1 11 fee shall be imposed. Notwithstanding section 321.145 or any
1 12 other provision of law to the contrary, the administrative fee
1 13 collected by the department shall be remitted to the county
1 14 treasurer of the county where the licensee resides for use by
1 15 the county attorney in providing legal assistance in domestic
1 16 abuse actions in accordance with section 236.3B.
1 17 EXPLANATION
1 18 This bill provides for an additional $100 administrative
1 19 fee when a person seeks to reinstate a license after the
1 20 license has been cancelled, suspended, or revoked and the
1 21 person is required to pay a $20 reinstatement fee. Instead of
1 22 being credited to the road use tax fund, the $100 fee shall be
1 23 remitted to the county treasurer of the county where the
1 24 licensee resides to be used by the county attorney in
1 25 providing legal assistance in domestic abuse actions pursuant
1 26 to section 236.3B.
