1 1 Section 1. NEW SECTION. 557D.1 RESTRICTIVE COVENANT
1 2 RELATED TO INSTALLATION OF ANTENNAE PROHIBITED.
1 3 A restrictive covenant of any kind on real property which
1 4 prohibits or restricts the installation or construction within
1 5 a subdivision of an antennae which is to be used by a person
1 6 who has an amateur radio license issued by the federal
1 7 communications commission for the operation of a radio for
1 8 which the license is issued is void. This section does not
1 9 apply to a restrictive covenant existing on the effective date
1 10 of this Act until such time as the restrictive covenant has
1 11 expired.
1 12 EXPLANATION
1 13 This bill provides that a restrictive covenant related to
1 14 real property which prohibits or restricts the installation or
1 15 construction of an antennae within a subdivision which is to
1 16 be used by a person who has an amateur radio license issued by
1 17 the federal communications commission is void. The bill
1 18 provides that the prohibition created does not apply to any
1 19 existing restrictive covenant until such covenant expires.
