  1  1    Section 1.  Section 668.4, Code 1995, is amended to read as
  1  2 follows:
  1  3    668.4  JOINT AND SEVERAL LIABILITY.
  1  4    In actions brought under this chapter, the rule of joint
  1  5 and several liability shall not apply to defendants who are
  1  6 found to bear less than fifty percent of the total fault
  1  7 assigned to all parties.  
  1  8                           EXPLANATION
  1  9    This bill eliminates joint and several liability in
  1 10 comparative fault actions.  Currently, joint and several
  1 11 liability exists only in the event that a defendant is found
  1 12 to bear at least 50 percent of the total fault assigned to all
  1 13 parties.
