1 1 Section 1. NEW SECTION. 719.1A DISARMING A PEACE
1 2 OFFICER.
1 3 1. A person shall not knowingly remove a firearm from a
1 4 peace officer or deprive a peace officer of a firearm when the
1 5 officer is acting within the scope of the officer's duties and
1 6 the person knows or should know that the other person is a
1 7 peace officer. A person who violates this subsection commits
1 8 a class "A" felony.
1 9 2. A person shall not knowingly attempt to remove a
1 10 firearm from a peace officer or attempt to deprive a peace
1 11 officer of a firearm when the officer is acting within the
1 12 scope of the officer's duties and the person knows or should
1 13 know that the other person is a peace officer. A person who
1 14 violates this subsection commits the following:
1 15 a. A class "B" felony if the firearm is discharged in the
1 16 attempt.
1 17 b. A class "C" felony if the firearm is not discharged in
1 18 the attempt.
1 19 EXPLANATION
1 20 This bill creates the offense of disarming a peace officer.
1 21 A person commits a class "A" felony if the person disarms the
1 22 officer or deprives the officer of the use of the officer's
1 23 firearm or commits a class "B" felony if the person attempts
1 24 to disarm the officer or attempts to deprive the officer of
1 25 the officer's firearm and the firearm is discharged. A person
1 26 commits a class "C" felony if the person attempts to disarm
1 27 the officer or attempts to deprive the officer of the
1 28 officer's firearm and the firearm is not discharged.
