1 1 Section 1. Section 20.8, Code 1995, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. Public employees excluded from
1 4 the provisions of this chapter pursuant to section 20.4 shall
1 5 not have their rights or benefits of employment affected by a
1 6 collective bargaining agreement or an arbitrator's decision
1 7 rendered pursuant to this chapter or rendered pursuant to a
1 8 collective bargaining agreement except as provided by section
1 9 70A.1.
1 10 Sec. 2. Section 20.22, subsection 9, paragraph b, Code
1 11 1995, is amended to read as follows:
1 12 b. Comparison of wages, hours and conditions of employment
1 13 of the involved public employees with those of other public
1 14 employees and private sector employees in this state doing
1 15 comparable work, giving consideration to factors peculiar to
1 16 the area and the classifications involved.
1 17 Sec. 3. Section 70A.1, Code 1995, is amended by adding the
1 18 following new unnumbered paragraph:
1 19 NEW UNNUMBERED PARAGRAPH. The salaries and benefits of
1 20 state employees, except those employees or officials whose
1 21 salaries are set by statute, who are not represented by an
1 22 employee organization shall be adjusted in the same manner
1 23 that is equivalent to the adjustments negotiated for
1 24 represented employees.
1 25 EXPLANATION
1 26 The bill provides that public employees excluded from the
1 27 provisions of chapter 20 pursuant to section 20.4 shall not
1 28 have their employment affected by chapter 20 or a collective
1 29 bargaining agreement except for certain salary and benefit
1 30 provisions of section 70A.1.
1 31 The bill requires an arbitrator to consider as a factor the
1 32 salaries and benefits of similarly situated private sector
1 33 employees in Iowa when rendering a decision concerning an
1 34 impasse item in dispute.
1 35 The bill also provides that unrepresented state employees
2 1 are entitled to the same adjustment to their salaries and
2 2 benefits as obtained by represented state employees under a
2 3 collective bargaining agreement.
