1 1 Section 1. NEW SECTION. 513B.38A COMMISSIONER'S
1 2 AUTHORITY &endash; PREVENTIVE CARE SERVICES &endash; MENTAL HEALTH AND
1 3 SUBSTANCE ABUSE TREATMENT.
1 4 Upon the determination of the commissioner pursuant to
1 5 section 513B.37, subsection 1, paragraph "a", to include
1 6 expanded preventive care services and mental health and
1 7 substance abuse treatment coverage in basic benefit coverage
1 8 policies or subscription contracts, the commissioner shall do
1 9 both of the following:
1 10 1. Adopt by rule, with all due diligence, requirements for
1 11 the provision of expanded coverage for benefits for expanded
1 12 preventive care services.
1 13 2. Adopt by rule, with all due diligence, requirements for
1 14 the provision of coverage for benefits for services for
1 15 clinical disorders related to mental health and substance
1 16 abuse which shall be on the same terms as provided for other
1 17 conditions.
1 18 EXPLANATION
1 19 This bill provides that upon a determination by the
1 20 commissioner to include expanded preventive care services and
1 21 mental health and substance abuse treatment coverage in basic
1 22 benefit coverage policies or subscription contracts offered
1 23 pursuant to chapter 513B, the commissioner is to adopt by
1 24 rule, with all due diligence, requirements for the provision
1 25 of expanded coverage for benefits for expanded preventive care
1 26 services, and requirements for the provision of coverage for
1 27 benefits for services for clinical disorders related to mental
1 28 health and substance abuse which shall be on the same terms as
1 29 provided for other conditions.
