1 1 Section 1. Section 232.45, subsection 2, Code 1995, is
1 2 amended to read as follows:
1 3 2. The court shall hold a waiver hearing on all such
1 4 motions. The hearing shall not be open to the public.
1 5 Sec. 2. Section 232.45, Code 1995, is amended by adding
1 6 the following new subsection:
1 7 NEW SUBSECTION. 2A. A peace officer participating in or
1 8 associated with the investigation of a matter which is the
1 9 subject of a petition under subsection 1 shall not make or
1 10 participate in making an extrajudicial statement that a
1 11 reasonable person would expect to be disseminated by means of
1 12 public communication and that does more than state without
1 13 elaboration any or all of the following:
1 14 1. Information contained in a public record.
1 15 2. That the investigation is in progress.
1 16 3. The general scope of the investigation including a
1 17 description of the offense and, if permitted by law, the
1 18 identity of the victim.
1 19 EXPLANATION
1 20 This bill provides that hearings on a petition to have the
1 21 juvenile court waive its jurisdiction over a juvenile shall be
1 22 closed to the public. The bill also subjects law enforcement
1 23 personnel to certain of the restrictions on prehearing
1 24 statements that attorneys are subject to under Iowa code of
1 25 professional responsibility for lawyers, disciplinary rule 7-
1 26 107.
