PAG LIN 1 1 Section 1. The following amendment to the Constitution of 1 2 the State of Iowa is proposed: 1 3 1. Section 3 of Article III of the Constitution of the 1 4 State of Iowa is repealed and the following adopted in lieu 1 5 thereof: 1 6 REPRESENTATIVES. Sec. 3. The members of the House of 1 7 Representatives shall be chosen every second year, by the 1 8 qualified electors of their respective districts, and their 1 9 term of office shall commence on the first day of January next 1 10 after their election, and continue two years, and until their 1 11 successors are elected and qualified. A person shall not be 1 12 elected for a term as Representative if the term would result 1 13 in more than a total of twelve years of service or six two- 1 14 year terms as a Representative. If a person is elected or 1 15 appointed to serve a portion of a term to which some other 1 16 person was elected or appointed but that person died in office 1 17 or resigned from office or was otherwise removed from office, 1 18 those years served shall not be included in the terms of 1 19 office or total years of service. This limitation on the 1 20 number of terms and the years of service and the phase-in of 1 21 the four-year terms shall only apply to terms of office 1 22 beginning on or after January 1, 1999. 1 23 2. Section 5 of Article III of the Constitution of the 1 24 State of Iowa is repealed and the following adopted in lieu 1 25 thereof: 1 26 SENATORS &endash; QUALIFICATIONS. Sec. 5. Senators shall be 1 27 chosen for a term of four years, at the same time and place as 1 28 Representatives; they shall be twenty-five years of age, and 1 29 possess the qualifications of Representatives as to residence 1 30 and citizenship. A person shall not be elected for a term as 1 31 Senator if the term would result in more than a total of 1 32 twelve years of service or three four-year terms as a Senator. 1 33 If a person is elected or appointed to serve a portion of a 1 34 term to which some other person was elected or appointed but 1 35 that person died in office or resigned from office or was 2 1 otherwise removed from office, those years served shall not be 2 2 included in the terms of office or total years of service. 2 3 This limitation on the number of terms and the years of 2 4 service shall only apply to terms of office beginning on or 2 5 after January 1, 1999. 2 6 3. Section 2 of Article IV of the Constitution of the 2 7 State of Iowa, as amended by amendment number 1 of the 2 8 Amendments of 1972 and amendment number 1 of the Amendments of 2 9 1988, is repealed and the following adopted in lieu thereof: 2 10 ELECTION AND TERM. Sec. 2. The Governor and the 2 11 Lieutenant Governor shall be elected by the qualified electors 2 12 at the time and place of voting for members of the General 2 13 Assembly. Each of them shall hold office for four years from 2 14 the time of installation in office and until a successor is 2 15 elected and qualifies. A person shall not be elected Governor 2 16 or Lieutenant Governor if the term would result in more than a 2 17 total of twelve years of service or three four-year terms in 2 18 either office. If a person is elected or appointed to serve a 2 19 portion of a term to which some other person was elected or 2 20 appointed but that person died in office or resigned from 2 21 office or was otherwise removed from office, those years 2 22 served shall not be included in the terms of office or total 2 23 years of service. This limitation on the number of terms and 2 24 the years of service shall only apply to terms of office 2 25 beginning on or after January 1, 1999. 2 26 4. Section 22 of Article IV of the Constitution of the 2 27 State of Iowa, as amended by amendment number 1 of the 2 28 Amendments of 1972, is repealed and the following adopted in 2 29 lieu thereof: 2 30 SECRETARY &endash; AUDITOR &endash; TREASURER. Sec. 22. A Secretary 2 31 of State, an Auditor of State, and a Treasurer of State shall 2 32 be elected by the qualified electors at the same time that the 2 33 Governor is elected and for a four-year term commencing on the 2 34 first day of January next after their election, and they shall 2 35 perform such duties as may be provided by law. A person shall 3 1 not be elected Secretary of State if the term would result in 3 2 more than a total of twelve years of service or three four- 3 3 year terms as Secretary of State. A person shall not be 3 4 elected Auditor of State if the term would result in more than 3 5 a total of twelve years of service or three four-year terms as 3 6 Auditor of State. A person shall not be elected Treasurer of 3 7 State if the term would result in more than a total of twelve 3 8 years of service or three four-year terms as Treasurer of 3 9 State. If a person is elected or appointed to serve a portion 3 10 of a term to which some other person was elected or appointed 3 11 but that person died in office or resigned from office or was 3 12 otherwise removed from office, those years served shall not be 3 13 included in the terms of office or total years of service. 3 14 This limitation on the number of terms and the years of 3 15 service shall only apply to terms of office beginning on or 3 16 after January 1, 1999. 3 17 5. Section 12 of Article V of the Constitution of the 3 18 State of Iowa, as amended by amendment number 1 of the 3 19 Amendments of 1972, is repealed and the following adopted in 3 20 lieu thereof: 3 21 ATTORNEY GENERAL. Sec. 12. The General Assembly shall 3 22 provide, by law, for the election of an Attorney General by 3 23 the people, whose term of office shall be four years, and 3 24 until a successor is elected and qualifies. A person shall 3 25 not be elected Attorney General if the term would result in 3 26 more than a total of twelve years of service or three four- 3 27 year terms as Attorney General. If a person is elected or 3 28 appointed to serve a portion of a term to which some other 3 29 person was elected or appointed but that person died in office 3 30 or resigned from office or was otherwise removed from office, 3 31 those years served shall not be included in the terms of 3 32 office or total years of service. This limitation on the 3 33 number of terms and the years of service shall only apply to 3 34 terms of office beginning on or after January 1, 1999. 3 35 Sec. 2. The foregoing amendment to the Constitution of the 4 1 State of Iowa is referred to the General Assembly to be chosen 4 2 at the next general election for members of the General 4 3 Assembly and the Secretary of State is directed to cause the 4 4 same to be published for three consecutive months previous to 4 5 the date of that election as provided by law. 4 6 EXPLANATION 4 7 This joint resolution proposes an amendment to the 4 8 Constitution of the State of Iowa to provide that members of 4 9 the Iowa house of representatives shall not serve more than 4 10 six terms or twelve years as a representative and that members 4 11 of the Iowa senate shall not serve more than three terms or 4 12 twelve years as a senator. If a person serves a portion of a 4 13 term to which some other person was elected or appointed, the 4 14 partial term shall not be included in the number of terms or 4 15 total years of service. The limitation on the number of terms 4 16 and the years of service shall only apply to terms of office 4 17 beginning on or after January 1, 1999. 4 18 The amendment also provides that persons elected to the 4 19 office of governor, lieutenant governor, attorney general, 4 20 secretary of state, auditor of state, and treasurer of state 4 21 are limited to three terms or twelve years in each office. If 4 22 a person serves a portion of a term to which some other person 4 23 was elected or appointed, the partial term shall not be 4 24 included in the number of terms or total years of service. 4 25 The limitation on the number of terms and the years of service 4 26 shall only apply to terms of office beginning on or after 4 27 January 1, 1999. 4 28 The resolution, if adopted, would be referred to the next 4 29 general assembly before being submitted to the electorate for 4 30 ratification. 4 31 LSB 1104SS 76 4 32 sc/sc/14.3
