1 1 Section 1. Section 89.5, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 4. A rule adopted pursuant to this
1 4 section which adopts standards by reference to another
1 5 publication shall be exempt from the requirements of section
1 6 17A.6, subsection 4, if the following conditions exist:
1 7 a. The cost of the publication is an unreasonable expense
1 8 when compared to the anticipated usage of the publication.
1 9 b. A copy of the publication is available from an entity
1 10 located within the state capitol complex.
1 11 c. The rule identifies the location where the publication
1 12 is available.
1 13 d. The administrative rules coordinator approves the
1 14 exemption.
1 15 Sec. 2. PRESSURE VESSEL INTERNAL INSPECTIONS – EXTENSION.
1 16 Notwithstanding section 89.3, unfired steam pressure vessels
1 17 used as dryer rollers, steam condensate separators, or
1 18 condensate receivers, manufactured on or after January 1,
1 19 1994, with an allowable pressure of one hundred fifty pounds
1 20 per square inch and the safety relief valve set at a pressure
1 21 of one hundred fifty pounds per square inch, shall be
1 22 inspected externally on an annual basis and shall be inspected
1 23 internally for the second time before December 31, 1997.
1 24 Sec. 3. EFFECTIVE DATE. Section 1 of this Act, being
1 25 deemed of immediate importance, takes effect upon enactment.
1 26 EXPLANATION
1 27 Section 1 of this bill provides that the labor
1 28 commissioner, when the commissioner adopts rules concerning
1 29 boilers and unfired steam pressure vessels that adopt
1 30 standards by reference to another publication, is exempt from
1 31 the requirement that the publication referenced be deposited
1 32 in the state law library under certain conditions. The bill
1 33 provides that the requirement to deposit the publication in
1 34 the state law library is waived if the administrative rules
1 35 coordinator agrees, the cost of compliance is unreasonable,
2 1 the rule identifies the location of the publication, and the
2 2 publication is available within the state capitol complex.
2 3 This section of the bill takes effect upon enactment.
2 4 Section 2 is a temporary provision of law which provides
2 5 for the inspection of certain unfired steam pressure vessels
2 6 manufactured on or after January 1, 1994, with an allowable
2 7 pressure of 150 pounds per square inch and the safety relief
2 8 valve set at 150 pounds per square inch. The bill requires
2 9 that these vessels have an annual external inspection and a
2 10 second internal inspection completed before December 31, 1997.
