PAG LIN 1 1 Section 1. Section 321.178, subsection 1, unnumbered 1 2 paragraph 1, Code 1995, is amended to read as follows: 1 3AnThe department shall approve, by January 1, 1997, in 1 4 consultation with the department of education, the 1 5 instructional requirements for and the programming contents of 1 6 a driver education course. An individual shall not be 1 7 required to be a licensed teacher or hold a driver education 1 8 endorsement in order to teach an approved driver education 1 9 course in a public or nonpublic school or at a private or 1 10 commercial driver education school licensed by the department. 1 11 An approved driver education course as programmed by the 1 12 departmentof educationshall consist of at least thirty clock 1 13 hours of classroom instruction, and six or more clock hours of 1 14 laboratory instruction of which at least three clock hours 1 15 shall consist of street or highway driving. Classroom 1 16 instruction shall include all of the following: 1 17 Sec. 2. Section 321.178, subsection 1, unnumbered 1 18 paragraph 5, Code 1995, is amended to read as follows: 1 19 Any person who successfully completes an approved driver 1 20 education course at a private or commercial driver education 1 21 school licensed by the department, shall likewise be eligible 1 22 for a driver's license at the age of sixteen years, providing 1 23 the instructor in charge of the student's training has 1 24 satisfied the educational requirementsfor a teaching1 25certificate at the secondary level and holds a valid1 26certificate to teach driver education in the public schools of1 27Iowaas determined by the department. 1 28 Sec. 3. Section 321.180, subsection 1, paragraph b, Code 1 29 1995, is amended to read as follows: 1 30 b. Except as otherwise provided, a permittee who is 1 31 sixteen years of age or older must be accompanied by a person 1 32 issued a motor vehicle license valid for the vehicle operated 1 33 who is at least eighteen years of age and who is actually 1 34 occupying a seat beside the driver. Except as otherwise 1 35 provided, a permittee who is less than sixteen years of age 2 1 must be accompanied by a person issued a motor vehicle license 2 2 valid for the vehicle operated who is the parent or guardian 2 3 of the permittee, member of the permittee's immediate family 2 4 if the family member is at least twenty-one years of age, an 2 5 approved driver education instructor,a prospective driver2 6education instructor who is enrolled in a practitioner2 7preparation program with a safety education program approved2 8by the state board of education,or a person who is twenty- 2 9 five years of age or more if written permission is granted by 2 10 the parent or guardian, and who is actually occupying a seat 2 11 beside the driver. 2 12 However, if the permittee is operating a motorcycle, the 2 13 accompanying person must be within audible and visual 2 14 communications distance from the permittee and be accompanying 2 15 the permittee on or in a different motor vehicle. Only one 2 16 permittee shall be under the immediate supervision of an 2 17 accompanying qualified person, unless the qualified person is 2 18 an approved motorcycle or driver education instructoror a2 19prospective motorcycle or driver education instructor who is2 20enrolled in a practitioner preparation program with a safety2 21education program approved by the state board of education,2 22 and the permittee is enrolled in an approved motorcycle or 2 23 driver education course, in which case no more than three 2 24 students shall be under the immediate supervision of each 2 25 instructor while on the highway. 2 26 EXPLANATION 2 27 This bill strikes a provision in the Code that requires a 2 28 driver education instructor teaching at a private or 2 29 commercial driver education school to have a valid license to 2 30 teach at the secondary level and a certificate to teach driver 2 31 education in the public schools of Iowa. The bill also 2 32 strikes a provision that includes a prospective driver 2 33 education instructor, who is enrolled in a practitioner 2 34 preparation program with a safety education program approved 2 35 by the state board of education, in the list of people who may 3 1 accompany or supervise a driver who is operating a vehicle or 3 2 motorcycle under an instruction permit. 3 3 In addition, the instruction and programming responsibility 3 4 for the approved driver education course is transferred from 3 5 the department of education to the department of 3 6 transportation. The department of transportation is directed 3 7 to develop, approve, and implement by January 1, 1997, in 3 8 consultation with the department of education, the 3 9 instructional requirements for and the programming contents of 3 10 a driver education course. 3 11 The bill stipulates that an individual does not have to be 3 12 a licensed teacher or hold an endorsement to teach driver 3 13 education in a public or nonpublic school or at a private or 3 14 commercial driver education school.
