PAG LIN 1 1 Section 1. NEW SECTION. 279.8A TRAFFIC AND PARKING. 1 2 The board may make necessary rules to provide for the 1 3 policing, control, and regulation of traffic and parking of 1 4 vehicles and bicycles on school grounds. The rules may 1 5 provide for the use of institutional roads, driveways, and 1 6 grounds; registration of vehicles and bicycles; the 1 7 designation of parking areas; the erection and maintenance of 1 8 signs designating prohibitions or restrictions; the 1 9 installation and maintenance of parking control devices; the 1 10 imposition of parking fees; and assessment, enforcement, and 1 11 collection of reasonable penalties for the violation of the 1 12 rules. 1 13 Rules made under this section may be enforced under 1 14 procedures adopted by the board. Penalties may be imposed for 1 15 violation of the rules, including, but not limited to, a 1 16 reasonable monetary penalty. The rules made under this 1 17 section may also be enforced by the impoundment of vehicles 1 18 and bicycles for violation of the rules, and a reasonable fee 1 19 may be charged for the cost of impoundment and storage prior 1 20 to the release of the vehicle or bicycle to the owner. The 1 21 board shall establish procedures for the determination of 1 22 controversies in connection with the imposition of penalties. 1 23 The procedures must require giving notice of the violation and 1 24 the penalty prescribed and providing the opportunity for an 1 25 administrative hearing. 1 26 The board may contract with a city or county to enforce 1 27 rules made under this section by ordinance of the city or 1 28 county, and shall consult with local government transportation 1 29 officials to ensure that rules made pursuant to this section 1 30 are not in conflict with city or county parking and traffic 1 31 ordinances. 1 32 EXPLANATION 1 33 This bill authorizes a school district board to make rules 1 34 relating to the policing, control, and regulation of traffic 1 35 and parking of vehicles and bicycles on school property. The 2 1 rules may relate to traffic flow, vehicle registration, 2 2 parking area designation and fees, traffic signs, and parking 2 3 control devices. 2 4 The bill also provides for the imposition of penalties, 2 5 including reasonable monetary penalties and vehicle 2 6 impoundment for rule violations. A school district board 2 7 shall establish procedures for dispute resolution regarding 2 8 the imposition of penalties, including notice and the 2 9 opportunity for an administrative hearing. Additionally, the 2 10 board may contract with a city or county for enforcement of 2 11 rules by ordinance, and shall consult with local government 2 12 transportation officials to promote consistency with local 2 13 traffic and parking ordinances. 2 14 LSB 3697SV 76 2 15 rn/sc/14
