  1  1    Section 1.  Section 283A.2, subsection 2, Code 1995, is
  1  2 amended to read as follows:
  1  3    2.  All school districts shall operate or provide for the
  1  4 operation of school lunch programs at all public schools in
  1  5 each district.  A school district may operate or provide for
  1  6 the operation of school breakfast programs at all public
  1  7 schools in the district.  The programs shall provide students
  1  8 with nutritionally adequate meals and shall be operated in
  1  9 compliance with the rules of the state board of education and
  1 10 pertinent federal rules, laws and regulations.  School lunch
  1 11 programs shall be operated for all students in each district
  1 12 who attend public school four or more hours each school day
  1 13 and wish to participate in a school lunch program.  School
  1 14 districts may provide school lunch programs for other
  1 15 students.
  1 16    Sec. 2.  Section 283A.2, subsection 3, Code 1995, is
  1 17 amended by striking the subsection.
  1 18    Sec. 3.  Section 283A.2, subsection 2, Code 1993, as
  1 19 amended by 1994 Iowa Acts, chapter 1193, section 24, and which
  1 20 amendments take effect July 1, 2000, pursuant to 1994 Iowa
  1 21 Acts, chapter 1193, section 38, is amended by striking the
  1 22 subsection.
  1 23    Sec. 4.  1994 Iowa Acts, chapter 1193, sections 36 and 38,
  1 24 are repealed.  
  1 25                           EXPLANATION
  1 26    This bill strikes a mandate enacted in 1994 to take effect
  1 27 July 1, 1999, requiring schools to provide school breakfast
  1 28 programs.  Under the bill, a school district may provide a
  1 29 school breakfast program for all schools in the district, and
  1 30 if the district elects to do so, the program must provide
  1 31 students with nutritionally adequate meals and be operated in
  1 32 compliance with state administrative rules and pertinent
  1 33 federal laws and regulations.
