1 1 Section 1. NEW SECTION. 904.703A WORK OF INMATES OF
1 2 CORRECTIONAL INSTITUTIONS.
1 3 1. An inmate shall not perform work if the performance of
1 4 the work by the inmate would displace a person employed by a
1 5 state agency or political subdivision of the state or prevent
1 6 a person from becoming employed by a state agency or political
1 7 subdivision of the state.
1 8 2. An inmate shall not be placed on work release to work
1 9 with the public if the inmate is incarcerated on a sentence
1 10 for a forcible felony or sexual abuse in the third degree or
1 11 will be required to register upon release from custody with
1 12 the sex offenders registry under chapter 692A. An inmate who
1 13 is released to work with the public shall be directly
1 14 supervised by a correctional officer employed by the
1 15 department.
1 16 EXPLANATION
1 17 This bill prohibits an inmate from performing work if the
1 18 work of the inmate would displace a person employed by a state
1 19 agency or political subdivision of the state or prevent a
1 20 person from becoming employed by a state agency or political
1 21 subdivision of the state.
1 22 The bill also provides that an inmate shall not be released
1 23 to work with the public if the inmate is incarcerated on a
1 24 sentence for a forcible felony or sexual abuse in the third
1 25 degree or will be required to register upon release from
1 26 custody with the sex offenders registry. An inmate who is
1 27 released to work with the public shall be directly supervised
1 28 by a correctional officer employed by the department of
1 29 corrections.
