  1  1    Section 1.  Section 462A.31, subsection 1, paragraph b,
  1  2 Code 1995, is amended to read as follows:
  1  3    b.  A motorboat equipped with any power unit mounted or
  1  4 carried aboard the vessel may be operated at a no-wake speed
  1  5 on all artificial lakes of more than one hundred acres in size
  1  6 under the custody of the department.  However, on Big Creek
  1  7 lake and lake Macbride, a motorboat with a power unit
  1  8 exceeding ten horsepower may be operated only when permitted
  1  9 by rule and the rule shall not authorize such use during the
  1 10 period beginning on the Friday before Memorial Day and ending
  1 11 on Labor Day inclusively.  This paragraph does not limit
  1 12 motorboat horsepower on natural lakes under the custody of the
  1 13 department or limit the department's authority to establish
  1 14 special speed zoning regulations.
  1 15    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 16 immediate importance, takes effect upon enactment.  
  1 17                           EXPLANATION
  1 18    This bill strikes rule-making authority of the department
  1 19 of natural resources or the natural resource commission to
  1 20 regulate the operation of motorboats with more than 10
  1 21 horsepower differently on Big Creek Lake than on other
  1 22 artificial lakes.  Currently, on Big Creek Lake and Lake
  1 23 Macbride, motorboats with more than 10 horsepower may be
  1 24 operated only when authorized by rule, but not during a period
  1 25 between the Friday before Memorial Day and ending on Labor
  1 26 Day.  The rule relating to motor horsepower will apply to Lake
  1 27 Macbride only.
  1 28    The bill takes effect upon enactment.
