  1  1    Section 1.  Section 476.20, subsection 3, unnumbered
  1  2 paragraph 1, Code 1995, is amended to read as follows:
  1  3    The board shall establish rules which shall be uniform with
  1  4 respect to all public utilities furnishing gas or electricity
  1  5 relating to disconnection of service.  In addition to any
  1  6 other rules or requirements, the board shall provide for a
  1  7 minimum of three business days' notice to a customer prior to
  1  8 disconnecting electric or gas service as a result of tampering
  1  9 with the equipment furnished and owned by the utility.  This
  1 10 subsection applies both to regulated utilities and to
  1 11 municipally owned utilities and unincorporated villages which
  1 12 own their own distribution systems, and violations of this
  1 13 subsection subject the utilities to civil penalties under
  1 14 section 476.51.
  1 15    Sec. 2.  EMERGENCY RULES.  The utilities board shall adopt
  1 16 administrative rules under section 17A.4, subsection 2, and
  1 17 section 17A.5, subsection 2, paragraph "b", to implement the
  1 18 provisions of this Act and the rules shall become effective
  1 19 immediately upon filing, unless a later effective date is
  1 20 specified in the rules.  Any rules adopted in accordance with
  1 21 the provisions of this section shall also be published as
  1 22 notice of intended action as provided in section 17A.4.  
  1 23                           EXPLANATION
  1 24    This bill provides that an electric or gas utility must
  1 25 provide no less than three business days' notice to a customer
  1 26 prior to disconnecting electric or gas service as a result of
  1 27 tampering with the equipment furnished and owned by the
  1 28 utility.
  1 29    The bill directs the board to adopt emergency
  1 30 administrative rules under section 17A.4, subsection 2, and
  1 31 section 17A.5, subsection 2, paragraph "b", to implement the
  1 32 provisions of the bill and the rules are to become effective
  1 33 immediately upon filing, unless a later effective date is
  1 34 specified in the rules.
