1 1 Section 1. Section 321.376, subsection 1, Code 1995, is
1 2 amended to read as follows:
1 3 1. The driver of a school bus shall hold a driver's
1 4 license issued by the department of transportation valid for
1 5 the operation of the school bus and shall hold a school bus
1 6 driver's permit issued by the department of education when
1 7 transporting student or adult passengers to or from school
1 8 activities. The department of education shall charge a fee
1 9 for the issuance of a school bus driver's permit in the amount
1 10 of five dollars, which shall be deposited in the general fund
1 11 of the state. A person holding a temporary restricted license
1 12 issued under chapter 321J shall be prohibited from operating a
1 13 school bus. The department of education shall revoke or
1 14 refuse to issue a permit to any person who, after notice and
1 15 opportunity for hearing, is determined to have committed any
1 16 of the acts proscribed under section 321.375, subsection 2.
1 17 The department of education shall recommend, and the state
1 18 board of education shall adopt under chapter 17A, rules and
1 19 procedures for the revocation and issuance of permits to
1 20 persons. Rules and procedures adopted shall include, but are
1 21 not limited to, provisions for the revocation of, or refusal
1 22 to issue, permits to persons who are determined to have
1 23 committed any of the acts proscribed under section 321.375,
1 24 subsection 2. If after hearing under this subsection, the
1 25 department of education does not revoke the permit of a bus
1 26 driver, but suspends the permit for a specific time, or
1 27 suspends the permit pending the completion of course work or
1 28 rehabilitation services, the decision as to the continued
1 29 employment of the school bus driver lies with the board of
1 30 directors of the employing school district or the authorities
1 31 in charge of the employing nonpublic school.
1 32 EXPLANATION
1 33 This bill provides that the board of directors of a public
1 34 school district or the authorities in charge of a nonpublic
1 35 school are not required to continue the employment of a school
2 1 bus driver whose permit has been revoked under section 321.376
2 2 for a violation of section 321.375, subsection 2.
2 3 Section 321.375, subsection 2, provides that a school bus
2 4 driver is subject to immediate suspension pending a
2 5 termination hearing for use of nonprescription controlled
2 6 substances or alcoholic beverages during working hours,
2 7 operating a school bus while under the influence of a
2 8 nonprescription controlled substance or alcoholic beverage,
2 9 for fraud in the procurement or renewal of a school bus
2 10 driver's permit, or for the commission of or conviction of a
2 11 public offense if it is relevant to or affects driving ability
2 12 or involves sexual activity with a minor under certain
2 13 circumstances.
