PAG LIN 1 1 Section 1. NEW SECTION. 7D.36 STATE CONTRACT APPROVAL. 1 2 The executive council shall act upon contracts for the 1 3 expenditure of public funds that exceed five hundred thousand 1 4 dollars as provided in section 72.1. 1 5 Sec. 2. Section 72.1, Code 1995, is amended to read as 1 6 follows: 1 7 72.1 STATE CONTRACTSFOR EXCESS EXPENDITURES– EXECUTIVE 1 8 COUNCIL APPROVAL – EXCEPTION FOR COAL. 1 9 Officers empowered to expend, or direct the expenditure of, 1 10 public money of the state shall not make any contract for any 1 11 purpose which contemplates an expenditure of such money in 1 12 excess of five hundred thousand dollars without the prior 1 13 approval of the executive council or in excess of that 1 14 authorized by law. However, the state or an agency of the 1 15 state may enter into a contract of not exceeding ten years in 1 16 duration for the purchase of coal to be used in facilities 1 17 under the jurisdiction of the state or the state agency. The 1 18 execution of the contract shall be contingent upon 1 19 appropriations by the general assembly in sufficient amounts 1 20 to meet the terms of the contract. 1 21 EXPLANATION 1 22 This bill requires executive council approval before 1 23 awarding a contract for the expenditure of state moneys in 1 24 excess of $500,000.
