1 1 Section 1. NEW SECTION. 307.31 REPAIR OF OUT-OF-STATE
1 2 COMMERCIAL VEHICLES.
1 3 1. The operator of a commercial vehicle which is not
1 4 registered within the state as required pursuant to chapter
1 5 321 or 326 or which does not have an interstate fuel permit,
1 6 as required under chapter 452A, may enter the state and travel
1 7 to a commercial vehicle dealer or repair facility and exit the
1 8 state under the following circumstances:
1 9 a. If the commercial vehicle is entering the state solely
1 10 for the purposes of maintenance and repair to the commercial
1 11 vehicle and is exiting the state after having completed
1 12 vehicle maintenance or repair.
1 13 b. If the commercial vehicle dealer or repair facility is
1 14 located within a county abutting the border of the state.
1 15 c. If the operator has obtained a temporary entry or exit
1 16 permit from the commercial vehicle dealer or repair facility.
1 17 d. If the commercial vehicle is unladen.
1 18 2. The department shall implement an administrative
1 19 process in which a commercial vehicle dealer or repair
1 20 facility may provide a temporary entry or exit permit to an
1 21 operator which authorizes the operator to enter the state or
1 22 exit the state as allowed under this section. Any operator of
1 23 a commercial vehicle who has in the operator's possession, the
1 24 document allowing entry into the state or exit from the state,
1 25 shall not be charged with a registration violation under
1 26 chapter 321 or 326 or with a motor vehicle fuel tax violation
1 27 under chapter 452A.
1 28 3. For purposes of this section, "commercial vehicle"
1 29 means as defined in section 326.2.
1 30 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 31 immediate importance, takes effect upon enactment.
1 32 EXPLANATION
1 33 This bill allows the operator of a commercial vehicle which
1 34 is not registered within the state or which does not have an
1 35 interstate fuel permit to enter the state and travel to a
2 1 commercial vehicle dealer or repair facility and exit the
2 2 state under the following circumstances:
2 3 1. The commercial vehicle is entering the state solely for
2 4 the purposes of maintenance and repair to the commercial
2 5 vehicle and is exiting the state after having completed
2 6 vehicle maintenance or repair.
2 7 2. The commercial vehicle dealer or repair facility is
2 8 located within a county abutting the border of the state.
2 9 3. The operator has obtained a temporary entry or exit
2 10 permit from the commercial vehicle dealer or repair facility.
2 11 4. The commercial vehicle is unladen.
2 12 The bill requires the state department of transportation to
2 13 implement an administrative process so that a commercial
2 14 vehicle dealer or repair facility can provide a temporary
2 15 entry or exit permit to an operator when the operator takes
2 16 the vehicle for repair or returns from having the vehicle
2 17 repaired. Any operator who has in the operator's possession,
2 18 the document allowing entry into the state or exit from the
2 19 state, may not be charged with a registration violation under
2 20 chapter 321 or 326 or with a motor vehicle fuel tax violation
2 21 under chapter 452A.
2 22 This bill is effective upon enactment.
