1 1 Section 1. Section 657.11, Code Supplement 1995, is
1 2 amended by striking the section and inserting in lieu thereof
1 3 the following:
1 4 657.11 ANIMAL FEEDING OPERATIONS.
1 5 A person who brings a losing cause of action based upon a
1 6 claim of nuisance involving an animal feeding operation, as
1 7 defined in section 455B.161, shall be liable to the person
1 8 against whom the action was brought for legal fees and all
1 9 costs incurred in the defense of the action, if the court
1 10 determines that the claim was frivolous.
1 11 EXPLANATION
1 12 This bill provides that if a plaintiff brings a cause of
1 13 action based upon a claim of nuisance arising out of an animal
1 14 feeding operation, the plaintiff must pay the defendant legal
1 15 fees and all costs incurred in the defense of the action, if
1 16 the plaintiff loses and the court determines that the nuisance
1 17 claim was frivolous.
