PAG LIN 1 1 Section 1. Section 97B.52, subsection 3, paragraph b, Code 1 2 Supplement 1995, is amended to read as follows: 1 3 b. If a death benefit is due and payable, interest shall 1 4 continue to accumulate through the month preceding the month 1 5 in which payment is made to the designated beneficiary, heirs 1 6 at law, or the estate unless the payment of the death benefit 1 7 is delayed because of a dispute between alleged heirs, in 1 8 which case the benefit due and payable shall be placed in a 1 9 noninterest bearing escrow account until the beneficiary is 1 10 determined in accordance with this section. In order to 1 11 receive the death benefit, the beneficiary, heirs at law, or 1 12 the estate, or any other third-party payee, must apply to the 1 13 departmentwithin two years ofafter the member's death. 1 14 EXPLANATION 1 15 This bill eliminates the requirement that a beneficiary of 1 16 retirement death benefits under the Iowa public employees' 1 17 retirement system (IPERS) apply for benefits to the department 1 18 of personnel within two years of the IPERS member's death.
