PAG LIN 1 1 Section 1. NEW SECTION. 295.1 INTENT. 1 2 It is in the public interest to develop and fund classrooms 1 3 within the public school system of the state of Iowa to ensure 1 4 that school children, teachers, and administrators are 1 5 equipped and prepared to excel in the twenty-first century. 1 6 Sec. 2. NEW SECTION. 295.2 SCHOOL IMPROVEMENT AND 1 7 TECHNOLOGY ASSISTANCE TRUST FUND. 1 8 1. A school improvement and technology assistance trust 1 9 fund is created in the office of the treasurer of state under 1 10 the control of the department of education. There is 1 11 appropriated to the school improvement and technology 1 12 assistance trust fund for the fiscal year beginning July 1, 1 13 1995, and ending June 30, 1996, the sum of fifteen million 1 14 dollars from the general fund of the state. 1 15 2. The payment to a school district or area education 1 16 agency for a fiscal year shall be equivalent proportionately 1 17 to the allocation that school districts or area education 1 18 agencies would receive under phase III pursuant to section 1 19 294A.14 for that year. Of the moneys appropriated for the 1 20 fiscal year in subsection 1, the amount of twelve thousand 1 21 dollars shall be paid to the state board of regents for 1 22 distribution to the Iowa braille and sight saving school and 1 23 the state school for the deaf based upon the average student 1 24 yearly enrollment at each school as determined by the state 1 25 board of regents. The department of education shall notify 1 26 the department of revenue and finance of the amount to be paid 1 27 to each school district and area education agency. Payments 1 28 shall be made on a monthly basis commencing on October 15 and 1 29 ending June 15 of each fiscal year, taking into consideration 1 30 the relative budget and cash position of the state resources. 1 31 3. Any moneys received under this chapter, and any 1 32 interest accrued on the moneys, shall not be commingled with 1 33 state aid payments made, under sections 257.16 and 257.35, to 1 34 a school district or area education agency and shall be 1 35 accounted for by the school district and area education agency 2 1 separately from state aid payments. The Iowa braille and 2 2 sight saving school and the state school for the deaf shall 2 3 maintain a separate account for moneys received under this 2 4 chapter and any interest accrued on the moneys. 2 5 4. Payments made to school districts and area education 2 6 agencies under this chapter are miscellaneous income for 2 7 purposes of chapter 257. Each district and area education 2 8 agency shall maintain a separate listing within their budgets 2 9 for payments received and expenditures made pursuant to this 2 10 chapter. 2 11 5. Notwithstanding section 12C.7, interest or other income 2 12 earned by the fund shall remain in the school improvement and 2 13 technology assistance trust fund and used for the purposes of 2 14 the fund. 2 15 Sec. 3. NEW SECTION. 295.3 SCHOOL IMPROVEMENT AND 2 16 TECHNOLOGY COMMITTEES &endash; PLAN. 2 17 The board of directors of a school district, the Iowa 2 18 braille and sight saving school, the state school for the 2 19 deaf, and the board of directors of an area education agency 2 20 shall each establish a school improvement and technology 2 21 committee to develop a school improvement and technology plan 2 22 that includes an evaluation component. The evaluation 2 23 component shall be designed to measure the district's and the 2 24 agency's progress toward meeting its school improvement and 2 25 technology goals. The plan shall support and focus on the 2 26 improvement of student achievement and the attainment of 2 27 student achievement goals under sections 280.12 and 280.18. 2 28 The school improvement and technology plan shall be included 2 29 in the plan submitted by a district to the department of 2 30 education under section 280.18. Each committee shall be made 2 31 up of an equal number of administrators and instructional or 2 32 support staff. 2 33 Sec. 4. NEW SECTION. 295.4 SCHOOL IMPROVEMENT AND 2 34 TECHNOLOGY EXPENDITURES. 2 35 1. Funds received under this chapter by a school district, 3 1 the Iowa braille and sight saving school, the state school for 3 2 the deaf, or area education agency shall be expended for one 3 3 or more of the following purposes: 3 4 a. To provide additional time for activities and 3 5 responsibilities that are part of the school improvement and 3 6 technology plan approved by a school district, the Iowa 3 7 braille and sight saving school, the state school for the 3 8 deaf, or an area education agency and are in addition to the 3 9 regular activities and duties of the school district, the Iowa 3 10 braille and sight saving school, the state school for the 3 11 deaf, and its instructional staff or of the agency and its 3 12 school service personnel. 3 13 b. To provide for the costs of substitute instructional 3 14 staff to permit the regular instructional staff to engage in 3 15 planning or staff development activities that are part of the 3 16 school improvement and technology plan. 3 17 c. To provide for the costs associated with specialized or 3 18 general staff development that are part of the school 3 19 improvement and technology plan. 3 20 d. To purchase or lease telephone equipment, computers, 3 21 computer networks, computer programs, computer software, 3 22 computer systems, and for computer services as defined in 3 23 section 716A.1. 3 24 e. For maintaining purchases listed under this section. 3 25 f. The costs of establishing an electronic classroom, or 3 26 purchasing or leasing satellite equipment, receiving 3 27 equipment, studio and production equipment, and other 3 28 associated equipment. 3 29 g. The costs of purchasing or leasing audio, video, or 3 30 audiovisual machines, machinery, or equipment. 3 31 h. For instructional materials related to technology. 3 32 2. The education telecommunications council, created in 3 33 section 8D.5, shall recommend appropriate standards for the 3 34 educational technology to be purchased or leased under this 3 35 section. These technology standards shall ensure that 4 1 technology and infrastructure procured by school districts, 4 2 the Iowa braille and sight saving school, the state school for 4 3 the deaf, and area education agencies are compatible, uniform, 4 4 and interconnective. 4 5 EXPLANATION 4 6 This bill directs each school district and area education 4 7 agency, the Iowa braille and sight saving school, and the 4 8 state school for the deaf to establish a school improvement 4 9 and technology plan with an assessment component. The bill 4 10 creates a school improvement and technology assistance trust 4 11 fund and provides for an appropriation to the trust fund to 4 12 fund school improvement activities, staffing, and technology 4 13 relating to implementation of the school improvement and 4 14 technology plans. 4 15 Intent provided in the bill provides that it is in the 4 16 public interest to develop and fund classrooms within the 4 17 public school system to ensure that Iowa's school children, 4 18 teachers, and administrators are equipped and prepared to 4 19 excel in the 21st century. 4 20 The board of directors of a school district and the board 4 21 of directors of an area education agency, the Iowa braille and 4 22 sight saving school, and the state school for the deaf shall 4 23 each establish a school improvement and technology committee, 4 24 consisting of equal numbers of administrators and 4 25 instructional or support staff, to develop a school 4 26 improvement and technology plan that supports and focuses on 4 27 the improvement of student achievement and the attainment of 4 28 student achievement goals under sections 280.12 and 280.18. 4 29 Funds received by a school district, area education agency, 4 30 the Iowa braille and sight saving school, and the state school 4 31 for the deaf, under the bill shall be expended for one or more 4 32 of the following purposes approved under a school improvement 4 33 and technology plan: to provide additional time for 4 34 activities and responsibilities that are in addition to 4 35 regular activities and duties; to provide for the costs of 5 1 substitute instructional staff to permit regular instructional 5 2 staff to engage in planning or staff development activities; 5 3 to provide for specialized or general training costs; to 5 4 purchase or lease telephone equipment, computers, computer 5 5 networks, computer programs, computer software, computer 5 6 systems, and for computer services as defined in section 5 7 716A.1; for maintaining purchases listed in the bill; for 5 8 establishing an electronic classroom, or purchasing or leasing 5 9 satellite equipment, receiving equipment, studio and 5 10 production equipment, and other associated equipment; for 5 11 purchasing or leasing audio, video, or audiovisual machines, 5 12 machinery, or equipment; and for instructional materials 5 13 related to technology. 5 14 The education telecommunications council is directed to 5 15 recommend standards for the technology purchased pursuant to 5 16 the bill to ensure compatibility and uniformity. 5 17 The bill provides an appropriation of $15 million for FY 5 18 1995-1996 from the general fund of the state to the department 5 19 of education to be used for the school improvement and 5 20 technology program. Of the moneys appropriated, $12,000 is 5 21 allocated to the state board of regents to be distributed to 5 22 the Iowa braille and sight saving school and to the state 5 23 school for the deaf for purposes of the school improvement and 5 24 technology program. Payment to a school district or area 5 25 education agency for a fiscal year shall be equivalent 5 26 proportionately to the allocation that school districts or 5 27 area education agencies would receive under phase III pursuant 5 28 to section 294A.14 for that year. 5 29 LSB 2630SV 76 5 30 kh/jj/8
