  1  1    Section 1.  Section 331.802, subsection 2, Code 1995, is
  1  2 amended to read as follows:
  1  3    2.  If a person's death affects the public interest, the
  1  4 county medical examiner shall conduct a preliminary
  1  5 investigation of the cause and manner of death, prepare a
  1  6 written report of the findings, promptly submit the full
  1  7 report to the state medical examiner on forms prescribed for
  1  8 that purpose, and submit a copy of the report to the county
  1  9 attorney.  For each preliminary investigation and the
  1 10 preparation and submission of the required reports, the county
  1 11 medical examiner shall receive a fee determined by the board
  1 12 plus the examiner's actual expenses.  The fee and expenses
  1 13 shall be paid by the county for which the service is provided
  1 14 of residence of the person, except that the fee and expenses
  1 15 for a murder victim shall be paid through the expenditure of
  1 16 funds in the victim compensation fund created in section
  1 17 912.14.  The fee and expenses of the county medical examiner
  1 18 who performs an autopsy or conducts an investigation of a
  1 19 person who dies after being brought into this state for
  1 20 emergency medical treatment by or at the direction of an out-
  1 21 of-state law enforcement officer or public authority shall be
  1 22 paid by the state.  A claim for payment shall be filed with
  1 23 the Iowa department of public health.
  1 24    Sec. 2.  Section 912.14, Code 1995, is amended to read as
  1 25 follows:
  1 26    912.14  VICTIM COMPENSATION FUND.
  1 27    A victim compensation fund is established as a separate
  1 28 fund in the state treasury.  Moneys deposited in the fund
  1 29 shall be administered by the department and dedicated to and
  1 30 used for the purposes of section sections 331.802 and 709.10
  1 31 and this chapter.  Notwithstanding section 8.33, any balance
  1 32 in the fund on June 30 of any fiscal year shall not revert to
  1 33 the general fund of the state.  
  1 34                           EXPLANATION
  1 35    This bill provides for payment of the fee and expenses of
  2  1 the county medical examiner of the preliminary investigation
  2  2 and preparation of required reports relating to a person's
  2  3 death which affects the public interest, by the county of
  2  4 residence of the person or by the victim compensation fund if
  2  5 the person is a murder victim.  The bill also provides a
  2  6 conforming change to allow for expenditure of moneys in the
  2  7 victim compensation fund for the purpose established in the
  2  8 bill.
