  1  1    Section 1.  Notwithstanding the provisions of chapter 8D, a
  1  2 certified local exchange telephone company shall provide a
  1  3 connection to the Iowa communications network for a Part III
  1  4 user located within the company's service territory.  The
  1  5 connection, at a minimum, shall be for a facility with DS-3
  1  6 capacity and shall be provided at a cost of one dollar to the
  1  7 state.  The monthly fee for service provided to the Part III
  1  8 user shall be negotiated by the Iowa telecommunications and
  1  9 technology commission and paid by the state.  The commission
  1 10 shall develop and implement a financial plan to implement this
  1 11 program.  For purposes of this section, a Part III user means
  1 12 a public school or a nonpublic school as defined in section
  1 13 280.2.
  1 14    Sec. 2.  All authorized users of the network as provided in
  1 15 chapter 8D other than an institution under the control of the
  1 16 board of regents, a nonprofit institution of higher education
  1 17 eligible for tuition grants, an accredited nonpublic school,
  1 18 or a school corporation shall be charged a fee as determined
  1 19 by the commission, which shall be based on the ongoing
  1 20 operational costs of the network and the costs associated with
  1 21 the construction and debt service related to the network.
  1 22    Sec. 3.  The commission shall work with the legislative
  1 23 service bureau to develop proposed legislation to be offered
  1 24 during the 1996 regular session to make necessary statutory
  1 25 changes to chapter 8D necessary as a result of the passage of
  1 26 this Act.  
  1 27                           EXPLANATION
  1 28    This bill provides that a certified local exchange
  1 29 telephone company shall provide a connection to the Iowa
  1 30 communications network for a Part III user which is a school
  1 31 district or an accredited nonpublic school and which is
  1 32 located within the company's service territory.  The
  1 33 connection, at a minimum, shall be for a facility with DS-3
  1 34 capacity and shall be provided at a cost of $1 to the state.
  1 35    Authorized users of the network as provided in chapter 8D
  2  1 other than an institution under the control of the board of
  2  2 regents, a nonprofit institution of higher education eligible
  2  3 for tuition grants, an accredited nonpublic school, or a
  2  4 school corporation are to be charged a fee as determined by
  2  5 the commission, which is to be based on the ongoing

  2  8    The bill directs the commission to work with the
  2  9 legislative service bureau to develop statutory language
  2 10 changes which are necessary as a result of the passage of this
  2 11 bill.
