1 1 Section 1. NEW SECTION. 135.12 HEALTH CARE PROVIDER
1 2 RECORDS &endash; CERTIFIED DUPLICATES &endash; FEES.
1 3 The Iowa department of public health shall adopt rules
1 4 under chapter 17A prescribing uniform fees, based upon the
1 5 actual cost of duplication which includes but is not limited
1 6 to the cost of preparation of the record for duplication, that
1 7 a health care provider may charge for certified duplicate
1 8 health care records requested by an attorney to be admitted as
1 9 evidence at a trial or hearing. As used in this section,
1 10 "health care provider" means a person licensed to practice a
1 11 profession pursuant to chapter 147, a hospital licensed
1 12 pursuant to chapter 135B, or a health care facility licensed
1 13 pursuant to chapter 135C. The rules adopted may provide for
1 14 an additional fee based upon the actual costs for postage or
1 15 other means of delivery and may provide for an annual increase
1 16 based upon the annual rate of inflation for the preceding
1 17 calendar year as determined by the consumer price index
1 18 published by the bureau of labor statistics of the United
1 19 States department of labor.
