1 1 Section 1. Section 18.12, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 18A. Compile and annually update by
1 4 August 1, a list of personal computers deemed outmoded,
1 5 obsolete, and of no further service in carrying out the powers
1 6 and duties of the state agency that owns the personal
1 7 computers.
1 8 a. Each state agency shall annually submit to the director
1 9 of the department of general services by July 1, a list of
1 10 personal computers the agency has deemed outmoded, obsolete,
1 11 and of no further service in carrying out the powers and
1 12 duties of the state agency that owns the personal computers.
1 13 The director shall identify each item on the list, and the
1 14 agency that owns each item, and shall make the list available
1 15 to a public school district upon request. A public school
1 16 district may submit a request for a personal computer included
1 17 in the list compiled by the director to the agency that owns
1 18 the personal computer.
1 19 b. Upon receiving a request for a personal computer listed
1 20 as provided in this subsection, the agency shall transfer
1 21 ownership of the personal computer, at no charge, to the first
1 22 public school district to submit a request for the personal
1 23 computer. However, the public school district shall be
1 24 responsible for the costs of transporting the personal
1 25 computer from the agency to the district. After the transfer
1 26 of ownership to a school district, the state agency retains no
1 27 liability related to the personal computers.
1 28 c. A personal computer on a list submitted by an agency to
1 29 the director shall be stored or kept by the agency for one
1 30 year from the date on which the list was submitted to the
1 31 director. If a public school district does not request the
1 32 personal computer by June 30 of the following year, the agency
1 33 may dispose of the personal computer as necessary.
1 34 d. For purposes of this subsection:
1 35 (1) "State agency" means a legislative, executive, or
2 1 judicial office of the state and all of its respective
2 2 officers, departments, divisions, bureaus, boards,
2 3 commissions, and committees, except area education agencies,
2 4 community colleges, and institutions of higher learning under
2 5 the control of the state board of regents.
2 6 (2) "Personal computer" means an electronic device which
2 7 is designed for an individual user and performs logical,
2 8 arithmetical, and memory functions by manipulations of
2 9 electronic or magnetic impulses, and includes all input,
2 10 output, processing, storage, computer software, communications
2 11 facilities, and peripheral equipment connected to the personal
2 12 computer.
2 13 EXPLANATION
2 14 This bill requires each state agency to annually submit to
2 15 the director of the department of general services by July 1,
2 16 a list of personal computers the agency has deemed outmoded,
2 17 obsolete, and of no further service in carrying out the powers
2 18 and duties of the state agency that owns the personal
2 19 computers. The director shall compile and update the list
2 20 annually, and make it available to public school districts
2 21 upon request.
2 22 A district may request the personal computer listed from
2 23 the agency that owns the personal computer. Upon receiving a
2 24 request for a personal computer the agency shall give the
2 25 personal computer, at no charge, to the first public school
2 26 district to submit a request for the personal computer.
2 27 However, the public school district shall be responsible for
2 28 the costs of transporting the personal computer from the
2 29 agency to the district. A personal computer on a list
2 30 submitted by an agency to the director shall be stored or kept
2 31 by the agency for one year from the date on which the list was
2 32 submitted to the director. If a public school district does
2 33 not request the equipment by June 30 of the following year,
2 34 the agency may dispose of the personal computer as necessary.
2 35 "State agency", for purposes of this bill, means a
