1 1 Section 1. NEW SECTION. 321.447 RIDING ON MOTOR VEHICLE
1 2 PROHIBITED.
1 3 A person under the age of eighteen shall not ride and shall
1 4 not allow a person under the age of eighteen on a motor
1 5 vehicle or upon any portion of a motor vehicle not designed or
1 6 intended for use of passengers when the motor vehicle is in
1 7 motion. This section does not apply under any of the
1 8 following circumstances:
1 9 1. The motor vehicle is operated in a parade which is
1 10 officially authorized or otherwise permitted by law.
1 11 2. The motor vehicle is being operated for agricultural
1 12 purposes.
1 13 Sec. 2. Section 805.8, subsection 2, Code 1995, is amended
1 14 by adding the following new paragraph:
1 15 NEW PARAGRAPH. z. For riding on a motor vehicle or
1 16 allowing a person to ride on a motor vehicle in violation of
1 17 section 321.447, the scheduled fine is twenty-five dollars.
1 18 EXPLANATION
1 19 This bill creates new section 321.447 which prohibits a
1 20 person under the age of 18 from riding and prohibits an
1 21 operator from allowing a person under the age of 18 from
1 22 riding on any motor vehicle or upon any portion of a motor
1 23 vehicle not designed or intended for use of passengers when
1 24 the motor vehicle is in motion. The prohibition does not
1 25 apply to operation of a motor vehicle in a parade or while the
1 26 motor vehicle is being operated for agricultural purposes.
1 27 The scheduled fine for riding on or allowing a person to
1 28 ride on a motor vehicle in violation of section 312.447 is
1 29 $25.
