PAG LIN 1 1 Section 1. Section 321.319, Code 1995, is amended to read 1 2 as follows: 1 3 321.319 ENTERING INTERSECTIONS FROM DIFFERENT HIGHWAYS. 1 4 When two vehicles enter an intersection from different 1 5 highways or public streets at approximately the same time, the 1 6 driver of the vehicle on the left shall yield the right of way 1 7 to the vehicle on the right. The appropriate authorities, 1 8 when determining whether the driver on the left has violated 1 9 this section, shall consider, in addition to the direction in 1 10 which the vehicles were operating, any other relevant factors, 1 11 such as whether the vehicle on the right was being operated 1 12 within the speed limit and whether the vehicle on the right 1 13 was being operated recklessly. 1 14The foregoing ruleThis section is modified at through 1 15 highways and as otherwiseas hereinafterstated in this 1 16 chapter. 1 17 EXPLANATION 1 18 Section 321.319 requires that when entering an intersection 1 19 from different highways at approximately the same time the 1 20 driver on the left must yield the right of way to the vehicle 1 21 on the right. This bill provides that when determining 1 22 whether a violation of this section has occurred, the 1 23 appropriate authorities must consider other relevant factors 1 24 such as whether the vehicle on the right was operating within 1 25 the speed limit and whether the vehicle was being operated in 1 26 a reckless manner. 1 27 LSB 1740SS 76 1 28 js/jj/8
