  1  1    Section 1.  Section 411.36, subsection 1, paragraphs a, b,
  1  2 c, and d, Code 1995, as amended by 1995 Iowa Acts, Senate File
  1  3 45, section 3, are amended to read as follows:
  1  4    a.  Two fire fighters from different participating cities,
  1  5 one of whom is an active member of the retirement system and
  1  6 one of whom is a retired member.  The fire fighters shall be
  1  7 appointed by the governor from a list of at least three names
  1  8 submitted by the governing body of the Iowa association of
  1  9 professional fire fighters.
  1 10    b.  Two police officers from different participating
  1 11 cities, one of whom is an active member of the retirement
  1 12 system and one of whom is a retired member.  The police
  1 13 officers shall be appointed by the governor from a list of at
  1 14 least three names submitted by the governing body of the Iowa
  1 15 state police association.
  1 16    c.  The city treasurers of four participating cities, one
  1 17 of whom is from a city having a population of less than forty
  1 18 thousand, and three of whom are from cities having a
  1 19 population of forty thousand or more.  The city treasurers
  1 20 shall be appointed by the governor from a list of at least
  1 21 three names submitted by the governing body of the Iowa league
  1 22 of cities.
  1 23    d.  One citizen who does not hold another public office.
  1 24 The citizen shall be appointed by the other members of the
  1 25 board.  The treasurer of state, or the treasurer's designee.
  1 26    Sec. 2.  Section 411.36, subsection 2, Code 1995, is
  1 27 amended to read as follows:
  1 28    2.  Except as otherwise provided for the initial
  1 29 appointments, the The voting members, except for the treasurer
  1 30 of state or the treasurer's designee, shall be appointed by
  1 31 the governor, subject to confirmation by the senate, for four-
  1 32 year terms, and the nonvoting members shall be appointed for
  1 33 two-year terms.  Terms begin on May 1 in the year of
  1 34 appointment and expire on April 30 in the year of expiration.
  1 35    Sec. 3.  Section 411.36, subsection 5, paragraph a, Code
  2  1 1995, is amended to read as follows:
  2  2    a.  Members of the board, except the treasurer of state or
  2  3 the treasurer's designee, shall be paid their actual and
  2  4 necessary expenses incurred in the performance of their duties
  2  5 and shall receive a per diem as specified in section 7E.6 for
  2  6 each day of service.  Per diem and expenses shall be paid to
  2  7 voting members from the fire and police retirement fund
  2  8 created in section 411.8.
  2  9    Sec. 4.  EXPIRATION OF TERMS OF OFFICE OF BOARD.  The terms
  2 10 of office of members of the board of trustees for the
  2 11 statewide fire and police retirement system serving on the
  2 12 effective date of this Act shall continue until their
  2 13 expiration, except that the term of office of the citizen
  2 14 member shall expire on May 1, 1995, and the treasurer of
  2 15 state, or the treasurer's designee, shall become a member of
  2 16 the board on that date.
  2 17    Sec. 5.  EFFECTIVE DATE.  This Act, being deemed of
  2 18 immediate importance, takes effect upon enactment.  
  2 19                           EXPLANATION
  2 20    This bill provides for changes in appointment and
  2 21 membership of members of the board of trustees of the
  2 22 statewide police and fire retirement system.  The voting
  2 23 members presently appointed by the Iowa association of
  2 24 professional fire fighters, the Iowa state police association,
  2 25 and the Iowa league of cities will be appointed by the
  2 26 governor from lists of names submitted by the associations and
  2 27 the league and will be subject to senate confirmation under
  2 28 the bill.  The bill replaces the citizen member with the
  2 29 treasurer of state.  The term of office of the citizen member
  2 30 expires on May 1, 1995, and the terms of the remaining voting
  2 31 members expire with the expiration of the terms to which they
  2 32 were appointed under the bill.  The bill takes effect upon
  2 33 enactment.
